This is a good picture but Ukraine does not have Freedom of Panorama for monuments until 70 years after the death of the original architect unfortunately. Leoboudv (talk) 04:40, 7 July 2014 (UTC)[reply]

  • Is there really anything above COM:TOO pictured here? There is nothing more than a black stone with the inscription «1941 / 1943 ЖЕРТВАМ ФАШИЗМА» on it and an inscription «ПАМЯТЬ О ВАС — В НАШИХ СЕРДЦАХ.». Both the stone and texts are trivial, thus I do not see what can be copyrighted here — NickK (talk) 13:14, 7 July 2014 (UTC)[reply]

    • COM:TOO does not provide any information about how Ukrainian law deals with the threshold of originality, so this may be difficult. In my opinion this monument bears some originality: the placement of the tree trunks and the architectural build up in three parts. That's why I tend to  Delete.       Ukrainian laws do specify what exactly is protected by copyright (Article 8). The only object that does qualify here is "works of fine art" (8.1.8) with "work of fine art" defined as "a sculpture, painting, drawing, engraving, lithograph, a work of artistic (including stage) design, etc." (Article 1). The trunk itself cannot be protected, nor its placement (as this will most likely qualify as an "idea" or "concept" (Article 8.3). The author is unidentified as well, just a dash in the register of local historical monuments (note: the monument is protected for its historical value, not as architectural monument or monumental art), which may mean that there was no particular author behind this work. Deleted: The whole of the monument is certainly a creative work. It would easily have a copyright in the USA and there is no reason to believe that it would not be protected as "fine art" in Ukraine. The burden of proof is on those who would keep it to show beyond a significant doubt that it does not have a copyright, not the other way. .     Jim . . . .
