a classic example of a detailed photograph of a random passer-by or spectator of an event, not covered by German laws; no permission by depicted person documented; also out of scope AndreasPraefcke (talk) 13:06, 11 July 2013 (UTC)[reply]

 Keep

  • This person took part in a considerable heritage event. The picture is therefore permitted by §23 (1) Satz 3 KunstUrhG.
  • Although it is not necessary here: There exists no approach for documentation of permission of depicted persons on commons. If this would be suddenly necessary, hundert of thousends pictures must be deleted.
  • Scope: documentation of an important heritage event (200. anniversary btw), shows the antagonism between historical behavior and modern technology

Delete §23 (1) Satz 3 KunstUrhG says that it's allowed to take pictures of people at public events, but in this picture there's no reference to the event. Here is a german commentary to this law which supports my opinion. --Excolis (talk) 21:13, 11 July 2013 (UTC)[reply]
delete, per de:Wikipedia:BR#Aufnahmen_mit_Personen --Isderion (talk) 22:19, 11 July 2013 (UTC)[reply]
As Stepro states here (German), the picture was taken after the depicted person had stopped taking part in the "considerable heritage event".  Delete. Yellowcard (talk) 14:00, 12 July 2013 (UTC)[reply]

Delete Although I've the opinion that this is in form and content wrong, but that's not worth the discussion. --Stepro (talk) 19:11, 12 July 2013 (UTC)[reply]
