  •  Keep, not at all an artwork, and it doesn't belong to architecture (which is what the Italian NO-FOP and copyright law are about). It's a simple object, nothing more than that, and the fact that it is exposed to the public vision has nothing to do with a potentially expected enjoyment of art: its sole and sufficient function is to be seen, just like traffic lights, but notably a scarecrow is there to be seen by birds and hopefully frighten them no matter their artistic proficiency. It is indeed as much creative as a homemade cake can be: they are both made with care and shaped with emotion, they are usually garnished and often smell a little, but that's all: they are only handmade objects, not even the product of some craftsmanship.
