Ich fordere Sie auf das Foto in dieser und jeglicher anderer Veröffentlichung zu löschen! Sie haben hier Bilder / Fotos von Privateigentum erstellt, hierzu haben Sie keine Zustimmung des Eigentümers! Um genau dieses Bild mit dem Blickwinkel zu erstellen, musste das private Grundstück betreten werden und dafür liegt, bzw. lag Ihnen keine Genehmigung vor. The IP user claims that the image was not taken from public ways or places and that private grounds must have been entered to take the image. I'm not fully sure but I fear the IP user could be right, so the view would indeed not be covered by FoP Germany. If someone else wants to check, I assume the following photographer's position:

 Looking at the map, one sees that the photo shows the house from its western corner. That does not fit to the camera position given above. --Mussklprozz (talk) 21:56, 13 February 2021 (UTC)[reply]

Similar situation on 19 February 2021

I have been on the spot today, please find a similar image to the right. I'm still not sure whether the original photograph being discussed here is covered by FoP Germany or not. I'm quite sure, though, that the coordinates, which I assumed a few days ago are not fully correct. Deleted: thanks for the photo from the similar spot. It seems that the photo was taken from some elevated position, otherwise it would have been partially closed by the fence. As COM:FOP Germany says "When a photographer has used special tools (such as a ladder) to create the picture or has taken the picture after removing objects that otherwise would have shielded the work from the public eye (think of a photographer brushing aside the branches of a hedge to get a better view of a sculpture), § 59(1) cannot be relied upon for the resulting view is no longer part of what the general public can visually perceive from the public place."
