Picture of copyrighted work. No freedom of panorama in Denmark. Uploader has uploaded this picture previously (I assume it is File:The sculpture "Fundamentalism" - Copenhagen.jpg or maybe File:The sculpture "Fundamentalism".jpg). Pugilist (talk) 13:36, 20 February 2017 (UTC)
The owner of the sculpture and the picture has uploaded a declaration stating, that he has giving a Creative Commons Attribution-share Alike 4.0 International license to the picture. See it here: http://www.galschiot.com/pictures-copyright/ The picture should therefore not be deleted. Henry2430 14:48, 20 February 2017.
- Thanks for clarifying. I see that the copyright notice/CC licence was added just after last deletion. With the CC licence it should be sufficient. --Pugilist (talk) 16:45, 20 February 2017 (UTC)
Delete There are two copyrights which must be licensed here, the one for the photographs and the other for the sculptures. I don't know if it is inadvertent, or if the sculptor is being too careful, but the cited release is only for the photographs and does not release the copyright in the sculptures:
- "PICTURES - COPYRIGHT
- I hereby affirm that I Jens Galschiot, the creator and sole owner of the exclusive copyright of the following pictures...."
- "PICTURES - COPYRIGHT
Without his giving a clear release for the copyright for the sculptures, we cannot keep the images of them on Commons. I can understand why he might not want to give such a release using our standard form, since it would allow people to make and sell 3D copies of his sculptures.
Let's keep this on hold for a few days to see if Henry2430 can get Jens Galschiot to give us a complete release. He might want to consult counsel, but something along these lines would do it, I think:
- "I hereby affirm that I, Jens Galschiot, am the creator and sole owner of the exclusive copyright of the following photographs and of the sculptural works shown in them. With respect to the sculptural works, this license covers only their appearance in the photographs licensed hereby and does not permit any other use.
- I agree to publish the above-mentioned content under the free license:
- Creative Commons Attribution-share Alike 4.0 International.
- I acknowledge that by doing so I grant anyone the right to use the work in a commercial product or otherwise, and to modify it according to their needs, provided that they abide by the terms of the license and any other applicable laws.
- I am aware that this agreement is not limited to Wikipedia or related sites.
- I am aware that I always retain copyright of my work, and retain the right to be attributed in accordance with the license chosen. Modifications others make to the work will not be claimed to have been made by me.
- I acknowledge that I cannot withdraw this agreement, and that the content may or may not be kept permanently on a Wikimedia project."
