- Delete while the image is freely licenced the French artist died in 1966 so as a derivative work this painting is in copyright until 70 years pma., i.e., until 2037. Ww2censor (talk) 23:26, 30 April 2016 (UTC)

- Comment There is virtually nothing to stop people licensing falsely, due to lack of knowledge, ignorance or even fraud. We have to go by the copyright laws of the country of origin and the US, where the servers are based. Unfortunately French artworks are copyright for 70 years after the death of the artist. You might be able to use it as a non-free image in an article about that specific painting, but rarely in the biography of the artist as an example of their work, on the enwiki and any other wiki that allows non-free media but the commons does not allow such images. - Comment: As the coordinator of the Wikidata:Europeana Art History Challenge around which this file was uploaded I am not in a position to comment on whether it should or shouldn't be deleted. However:
- 1) I would suggest that this parallel deletion discussion should be treated as part of this one as they are effectively the same circumstances: Commons:Deletion requests/File:Girl Portrait (Marcel Janco).jpeg
- 2) Europeana is not the creator of the copyright tag that was listed with this artwork on the Europeana website - it is the responsibility of the providing GLAM to indicate what license the artwork carries.
- 3) The METADATA for the artworks on that site is definitely CC0 and in some circumstances the GLAM doesn't differentiate in their upload-form the different license between the metadata and the file/artwork itself. I have asked for clarification in these two artworks' circumstances. It is possibly just a mistakenly tagged license.

- Keep. CC0 is a valid licence on this site. If the institution that owns this artwork has decided to licence it as CC0 then who are we to argue? Or is there something specific in French law that artists keep the copyright on paintings even if they've sold the painting? WereSpielChequers (talk) 04:11, 5 May 2016 (UTC)
- Comment unfortunately, ownership of a painting does not confer any rights to the owner which remains with the artist, so the licence on the site is false, probably due to ignorance of copyright law. Ww2censor (talk) 22:22, 5 May 2016 (UTC)
