Central element of the barnstar (Smurf) is a copyrighted drawing. Fram (talk) 10:22, 29 October 2021 (UTC)
- Comment Central element Smurf is credited to another Wikimedia file, File:Grand_Schtroumpf.jpg. If that is ok, this is too; if one is CV, it would seem both are and need deleting. -- Infrogmation of New Orleans (talk) 02:23, 30 October 2021 (UTC)
- The file Grand_Schtroumpf.jpg is licensed FoP-Belgium as part of a mural located near Brussels Central Station.--НУРшЯGIO(beware of the moose) 21:33, 30 October 2021 (UTC)

- Comment I'm not sure I buy the FOP claim on the original work. The text of the copyright template states that there are additional conditions that definitely do not meet a free license standard: "provided that the reproduction or the communication of the work is as it is found there" reads to me like a "no derivative works" requirement, or moreover, require that the image be an actual photograph of the original. What is uploaded at File:Grand Schtroumpf.jpg looks like a redrawing: note the uniform lighting on the image, and that the colors are near-matte (as matte as possible in a JPEG). I highly, highly doubt the actual work if photographed would have such clean lines, matte colors, and no evidence of reflections. Additionally, the FOP-Belgium license requires "that this reproduction or communication does not infringe upon the normal exploitation of the work", which seems like a restriction that would fall short of what we consider freely licensable for Commons purposes. It may be incompatible with the CC-BY-SA 4.0 license claimed by the uploaders. In short, FOP-Belgium does not seem to be the same as PD. I think a deeper look is required. 69.174.144.79 23:57, 26 November 2021 (UTC)
- Good questions/points. I have nominated for deletion discussion the image of which this one is derivative: Commons:Deletion requests/File:Grand Schtroumpf.jpg -- Infrogmation of New Orleans (talk) 00:57, 27 November 2021 (UTC)

- I took the picture when the wall was brand new: they made the painting in June 2018 and I took the picture the 30th of June. You can take a picture with no reflection there if you don't shoot straight above your head. .Anja. (talk) 20:24, 27 November 2021 (UTC)
- Keep This character/drawing comes from a public space close to the Central Station in Brussels. We have freedom of panorama here. Before uploading I only improved the colors. You can see the original here [1] (with light wall defects) .Anja. (talk) 10:28, 27 November 2021 (UTC)
Kept: FOP, no valid reason for deletion. --VIGNERON (talk) 18:35, 2 December 2021 (UTC)
