There is no evidence this photo was published before 1927. The apparent source is here, which does not say when this photo was first published, and does not specify its copyright status but links to a general claim on archive usage policies, which do not in anyway suggest this is in the public domain. - Keep Images taken prior to 1902 are in the public domain even if they remained with the photographer and never seen by the public. US case law also has sided with describing an image as published/made-public when it leaves the custody of the photographer. We have cases where we have photographic negatives were donated to an archive by the creator, and we assume they have not been made public, until proved so, by appearing in a magazine or newspaper, if they were created after 1902.
