When uploaded, the image description says this image cannot be used for archiving or for commercial purposes, yet when it was on flickr (now deleted as of 1-3-10), it had a free license. User:Zscout370 (Return fire) 19:37, 3 January 2010 (UTC)[reply]

The statement and the license conflict. That's a problem. Bigger problem is that Greenpeace Italy is probably not the copyright holder (doubt they sail all the way to Japan) so can't even license this image. Multichill (talk) 19:41, 3 January 2010 (UTC)[reply]
Actually according to the file's meta data it's en:Southern Ocean Whale Sanctuary. However the meta data also says Greenpeace. It may not me their Italian division. The bot is our guaranteee that the file was on Flickr with that license. It violates CC license terms and Flickr policy to change the license. And limitations on the CC license you choose is not valid either. So I say  Keep. --|EPO| da: 20:18, 3 January 2010 (UTC)[reply]
Delete Copyrighted work; unfortunately permissions granted are not sufficient for using on Commons (non-commercial). According copyright notes in metadata, the author is Jiri Rezac (another version of this shot can be seen in http://www.jirirezac.com/folio/places/index.htm. Copyright notice: http://www.jirirezac.com/pages/copyright.htm). I think there isn't any chance to keeping because there are no evidences that Greenpeace Italia was the copyright holder and, consequently, the original license of the file on Flickr (CC) was been chosen properly.--Nanae (talk) 12:13, 4 January 2010 (UTC)[reply]
Move to wikipedia and apply fair use. Wiki ian 10:15, 18 January 2010 (UTC)[reply]
Delete Sadly, I think this has to go too. I saw the same problem recently on a lot of Sea Shepherd images on Flickr. Clearly that uploader had no right to license these images he did. In this case, too, Flickr status cannot be considered "good enough", it seems. Ingolfson (talk) 09:20, 21 February 2010 (UTC)[reply]
Oh, and I don't see how fair use could appply. This is clearly replacable (just not easily so). Ingolfson (talk) 09:21, 21 February 2010 (UTC)[reply]
