{{PD-US-unpublished}} is hard to prove, and there's no reason to think that this work by an American artist well-published in his life was not published. Prosfilaes (talk) 07:39, 20 August 2019 (UTC)
Keep. At the time I uploaded this file, I did a fairly thorough though not exhaustive search to see if this painting had ever been published but could find no evidence that it had. Incidentally, merely being displayed in a gallery does not mean that a painting has been published. Rrburke (talk) 10:02, 20 August 2019 (UTC)
- It would be useful to have that noted on the file page or file discussion page somewhere. As Commons:Public_art_and_copyrights_in_the_US#Before_1978 points out American Tobacco Co. v. Werckmeister said that being displayed could cause a painting to be published, if there were no controls on copying.--Prosfilaes (talk) 12:20, 20 August 2019 (UTC)
Kept: I'll drop my objection, as this seems to be within the generally acceptable level of checking.Prosfilaes (talk) 06:53, 1 November 2019 (UTC)
