I am not sure if this is the right place to respond. I own this artwork. It is a commissioned portrait made by Warhol for Mr. Accame and Warhol transferred the artwork and the copyright to Mr Accame. Then I bought it. Topjur01 (talk) 06:51, 26 March 2019 (UTC)[reply]
User Topjur01's response to a deletion nomination for this same image on 5 Nov 2017 was different than what they say here. At that time, when an editor explained that, as with the purchase of a book, their ownership of the painting does not imply ownership of its copyright, Topjur01 replied:
Thanks for explaining. I understand. You are right. It should be on Wikipedia under the fair use.
It can be confirmed by email with Artists Rights Society, the administrator of Warhol’s copyrights, if the artist's estate still owns copyright in this painting. Glancing through copyright notices in a few Warhol catalogues on my shelves, including one of portraits, I believe it would have been unusual for Warhol to have given or sold copyright in an artwork he created. Thank you for reminding me about the 2017 discussion. I somehow forgot about it. I agree with the deletion. Today I uploaded the file under the fair use. Please delete this commons entry.
