On the source URL given, I can not see the photo anymore at all (with or without the 'Copyright © 2003-2012 Myspace LLC all right reserved'). I'm not sure but as the original CC license was confirmed by an admin in 2010 shouldn't that be enough? If not I'll inform the author of the image to give a new source for the licensing if he thinks it is still available under the previous CC license Optimale (talk) 15:35, 16 July 2012 (UTC)

As far as I understand myspace.com terms the copyright of Myspace does not apply to the content a user uploads to his account (http://www.myspace.com/Help/Terms?pm_cmp=ed_footer):

6. Proprietary Rights in Content on Myspace Myspace does not claim any ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, applications, or any other materials (collectively, "Content") that you transmit, submit, display or publish (“post”) on, through or in connection with the Myspace Services. After posting your Content on, through or in connection with the Myspace Services, you continue to retain any such rights that you may have in your Content, subject to the limited license herein. ...

So the uploader keeps the copyright and can release a photo with a CC license as it was done in this case. Optimale (talk) 14:43, 17 July 2012 (UTC)
