The copyright is explicitly owned by Cigaretten-Bilderdienst; see here. Whatever copyright Hoffman might have had, he gave it to the Cigaretten-Bilderdienst. The entire work is available for free online. And to clarify, this means that because it's an institutional author, the clock starts ticking from the year of publication, not the year of author's death, so it has been in public domain in Germany since 2006. --Vuo (talk) 07:35, 21 October 2018 (UTC)[reply]
Most countries tick the clock from the natural death date of the author, even if the copyright is transferred. My educated guess is that Germany is the same. For example, the Bavarian state government held the copyright for Mein Kampf, which just expired in 2016 since Hitler died in 1945. It's not being obtuse if the only arguments are "maybe" or "could be". Nevertheless, this passes the buck to Cigaretten-Bilderdienst Altona-Bahrenfeld. What's the status of this company? Hoffmann material with copyright that ended up in the hands of the German government was released in 800 px by the Bundesarchiv, but this is not a Bundesarchiv photo - so what happened to Cigaretten-Bilderdienst?
