The uploader claims this to be his own work, however there is reasonable doubt that this is not his own work. The painting bears a signature of some Sheikh Ajzal Ali and the uploader have not identified himself as Sheikh Afjal Ali. Nafsadh (talk) 02:27, 20 May 2015 (UTC)[reply]

It is not my work and rather I have merely taken a picture of this drawing. I am wondering whether it qualifies under fair use policy. If so, please suggest the necessary change. --A.M.R. (talk) 03:48, 20 May 2015 (UTC)[reply]
If it is not your work, it is a derivative of a artwork. Unlike architecture, publicly showcased sculptures and buildings, a photograph of a painting is not exempted from copyright law. Thus the photo taken by you of this painting is copyrighted by the original painter. So, you do not have the right to upload this picture and cannot release it under any license, only the original artist can release it.
As it is a copyrighted material, this file does not qualify to be hosted in Commons. If you can find a fair usage rational for having this painting you can host that in related Wikipedia (e.g. Wikipedia English). But, there is no fair usage rational for having it in EnWiki either.
