This file is taken from this page. On the bottom of the page it is clearly marked that the page is released under CC BY-NC-ND 3.0 RS licence. That licence is not permitted to be used in Wikimedia Commons because it does not allow commercial use. See there: COM:L. The uploader claims it to be free under the Serbian copyright law which states thar "official material of a Republic of Serbia state body or a body performing public functions" is free of copyrights. But the photograph of a minister on a web site cannot be claimed to be "official material". According to Wikimedia policies, the uploader must prove that the uploaded file is not copyrighted when uploading. So, unless someone proves that this is "official material", using reliable sources, the file should be deleted. Vanjagenije (talk) 17:54, 16 June 2013 (UTC)[reply]

  •  Delete If this is even tagged with cc-by-nc-nd, then obviously the government at least thinks these images can be copyrighted. And most likely it's right: "official material" as I read it includes things meant for governmental information, but not random images just because they come from a government site. Also who says this was actually produced by a government officer? It's likely that they hired a private photographer. darkweasel94 03:47, 17 June 2013 (UTC)[reply]
Comment: I sent an e-mail to the Intellectual Property Office of the Republic of Serbia asking what are official materials as meant in the Law and if photos from government web sites can be defined as such. They answered me that their opinion is that this category (official materials) covers only: official acts, drawings and blueprints of building and cadaster agencies, diplomas, certificates, official reports of government agencies, statistical reports, drafts of Laws and other documents. They also explicitly state in their answer that we cannot include any photo from government's web sites in the category of official materials, nor anything else from government's web sites not included in the aforementioned categories.
