Although these photos are licensed at Flickr, there is a notice at the uploaders profile which says that "Any institutions or individuals using this site or any of its associated sites for studies or projects - You do NOT have my permission to use any of my profile or pictures in any form or forum both current and future. If you have or do, it will be considered a serious violation of my privacy and will be subject to legal ramifications." I think this raises questions of whether Commons re-users will be at legal risk if they use these photos. It also makes me wonder whether the Flickr user fully understood what the Creative Commons license meant. We have generally defended the right of anyone to reuse Commons images for any reason, even commercially but equally important is that images should be free for people to reuse in studies.
