Probably copyright violation: not in line with the Copyright Act of the Netherlands:

  1. FOP is not applicable to this artwork because:
    1. This sculpture is not in a public place because there is an entrance fee required, see https://www.hortusharen.nl/en/practical-information/entry-fee-season-2019-2020/.
    2. The sculpture was put on display during temporary exhibitions, see Website Hortus Haren, so they are not permanently on this place, as is required for FOP in the Netherlands.
  2. As far as I can judge, this artwork is contemporary art from a Dutch artist, the artist cannot be dead for at least 70 years (he/she might even be all still alive), and therefor these artworks are not in the public domain.
  3. The file has not an OTRS permission.

This might apply for all of the files in Category:Sculptures in Hortus (Haren, Groningen), except for File:Antoon Versteegde Flags on Hanging Gardens.jpg because this picture was uploaded by the artist himself.

Could you please look into this? (If this is indeed so, would you please keep the category and put a message there that it is not allowed to upload photographs of sculptures exhibited in Hortus (Haren, Groningen)? )

The same user has made the same request for this file on this page with similar arguments. There an extensive discussion of relevant legal matters and a process to ask the sculptors involved for permission has been started.
