Author, Joanna Ptak (Poland), died in 1946, so we must use URAA. Photo is made in 3th January 1939, so it is in PD in the USA in 95 years after made. PD-Poland is not applicable, because we don't know when the photo was published. Matlin (talk) 22:16, 10 March 2022 (UTC)[reply]

 Question Was this published at all before 2003? If it was not, the URAA did not apply and {{PD-US-unpublished}} would apply, and the photograph would be in the PD in the US because its author died before 1952. --Rosenzweig τ 11:20, 15 August 2022 (UTC)[reply]

Kept: I do not see sufficient arguments for deleting this image. 1. Possibly not published per Rosenzweig. 2. The Wikimedia Foundation – through the statement of the Legal department - does not see a reason to delete content simply because of general concern about the URAA. The document on Commons at COM:URAA states “A mere allegation that the URAA applies to a file cannot be the sole reason for deletion.” I decided to keep the image, because it has a correct licence for the country where it originated. In addition, the file page is showing a warning sign that a licence tag is missing which will show the image is possibly not in public domain in the USA which will prevent re-users from the USA to use it freely without additional research. If you do not agree with this decision, you are kindly requested to nominate the image again for deletion in order to have a broader discussion about it. --Ellywa (talk) 20:37, 16 August 2022 (UTC)[reply]
