The owner of this home contends it is not possible to take this photo without taking it from private property, and no permission was granted. It appears the photo was taken from or near Gilbert Lane, which according to the article en:Fair Lawn (Cold Spring, New York) is private property. The homeowner has provided File:Fair Oaks Farm.jpg as a replacement, and is in the process of finalizing permission. Sphilbrick (talk) 17:57, 25 November 2013 (UTC)
- I plead completely guilty to taking the photo that way. I could argue that this is not a valid reason to delete the image, as under U.S. law the location of the photographer is irrelevant to any FoP claim (which wouldn't apply to a building this old anyway), and I can't find anything specific in our deletion or privacy policies about pictures taken on private property of private property not visible from a public place without permission (i.e., while trespassing), but in the interest of being nice and diplomatic I won't kick up a fussy objection over this. It's the right thing to do, and the replacement image will need some cropping but it does show the side of the house I'd like to show.
Would the homeowner be interested in working with me to take a higher-res image or set of images? Please ask and let me know. Daniel Case (talk) 20:39, 25 November 2013 (UTC)
- It is my opinion that we are not obligated to remove the image, however, I think it would be a nice gesture to do so. While I cannot reveal the details of the email, I was under the impression we would receive a nice photo in exchange, and while the one provided is decent, it is less of a close up that the prior one. I do have permission from the owner to share their email address with Daniel so I will do so via email.--Sphilbrick (talk) 20:56, 25 November 2013 (UTC)
