Based on Tineye, the image also appears on http://www.flickr.com/photos/36149798@N03/3777619576/ with all rights reserved, and has been marked as being created by a third party (not the Flickr account holder). In this situation a release from the photographer would be required, either on a website or explicitly via OTRS. (talk) 09:00, 20 January 2011 (UTC)[reply]

I have done some research and found a contact of the supposed copyright holder. (markus.zinner@airtoair.at) I'm just composing an email to ask him if the upload and license was correct. I also read on the discussion page of the original uploader that he complained that he would obey copyright and licenses and found it unfair that some of the licenses of pictures he uploaded were challenged (and deleted). I will try and give it a shot to ask the copyright holder of this image if it is rightfully uploaded or not. I've got an answer from the creator of this work. He says the work was released by the Austrian Bundesheer. The only restriction is that you have to name the creator as "BMLVS/Markus Zinner" which seems to be CC. How shall I proceed?
