- 1) According to Danish copyright law the primary issue of violating copyright is in terms of commercial exploitation. Due to the fact that neither Wikimedia nor me as the creator of the image is gaining profit from the image it's hard to see how my image is basically violating the copyright of EBU's logo/advertising.
- 2) The logo is already present in the entire city of Copenhagen and thus visible to the public - the mere nature of this advertising is to be public. The advertising as well as the logo has not been altered in any way. The image shows it just the way it is presented by the EBU.
- 3) My image is named 'street advertising'. However, depending on how you define things the street advertising is just part of the whole image. The EBU logo is actually less than 10-15% of the entire image. The building in the background counts for around 20% and all of the surroundings for around 2/3's of the entire image. Bottom line is: No violation of the copyright has taking place. --Morten Haagensen (talk) 08:36, 4 May 2014 (UTC)
- 1) The CC-BY SA license on the photo states that anyone is free "to share – to copy, distribute and transmit the work". That includes printing and selling the photo. That would be a copyright violation, since it is a photo of a poster that is copyrighted.
- 2) It doesn't matter if it is visible to the public. It is a copyrighted poster.
- 3) It is a photo of a copyrighted poster. You cannot upload copyrighted material to Wikimedia Commons, and you also cannot claim "source: Own work".
