- Per communications with Rescate Mineros, the photo is non-commercial / press use only and not compatible with use on Wikimedia Commons. I'm forwarding communication to OTRS to keep records, and will go ahead and can take care of deletion soon. -Aude (talk | contribs) 20:25, 14 October 2010 (UTC)
Keep The file was uploaded to flickr as CC-BY, that means you can't revoke it after you publish it; or impose other conditions than the required attribution, which we are already complying in Commons. Diego Grez return fire 20:29, 14 October 2010 (UTC)
- At the same time, they noted in all caps "NO SALES, EDITORIAL USE ONLY". It's clear to me they intended to select CC-BY-NC (non-commercial) but didn't understand the options. I think we should definitely not keep the photo. That said, one of the photos might be used under fair use on English Wikipedia (upload a small version there). Delete A specific note under each photo specifically disallows commercial usage. Commons has never been predatory about licenses, but instead understands licenses are confusing and complex and always tries to follow the authors' intentions.
