This file has two problems:
- It is claimed to be an official work under § 5 Abs. 1 UrhG, but according to Commons:WikiProject Public Domain/German stamps review, only literary works are official works under that provision. Therefore, that copyright tag is wrong.
- It is claimed to be an anonymous work, but according to de:Anonymes Werk (Urheberrecht)#Frühere Rechtslage in Deutschland/Übergangsrecht, it seems that a precondition for this to be an anonymous work is that the work was first published posthumously (i.e. after the death of the anonymous author), but still within 70 years after the creation of the work. There is no evidence that this is the case, so the work will have to be assumed not to be anonymous. There is no evidence that the author died more than 70 years ago. - Transfer to English Wikipedia where they can use it as fair use. Agree that German copyright law doesn't allow us to host this on commons, but English can use it, so let them keep it. Ego White Tray (talk) 01:44, 2 July 2014 (UTC)
- Keep This tilting at windmills is tiresome. If this image (or others like it) can't be determined to be public domain by our criteria, then our criteria are wrong. This poster was a work by a government that has since been dissolved. Chris Troutman (talk) 03:13, 6 July 2014 (UTC)
- Question How does paragraph 134 apply to this image? The text of the template implies that this is public domain as an older than 70 year government work. If this is not the case then the template {{PD-Germany-§134}} needs revision. Ego White Tray (talk) 03:35, 6 July 2014 (UTC)
