The source and possibly date of the photo appear to be incorrect and there is not enough information to determine whether the photo is in the public domain.

The indicated source is Irving Berlin's Show Business, which is available to borrow through the Internet Archive. I skimmed through the entire book but did not find the photo. The description dates it to 1941, so presumably it would appear somewhere between pages 121–190, which spans the three chapters covering periods that touch 1941: "Hollywood 1934–1941", "America 1938–1945", and "Broadway 1940–1949". However I tend to think the 1941 date is spurious, as Berlin's age and appearance in the photo looks more similar to photos of him from the mid-1950s onward.

While it seems likely enough that the photo was created pre-1964, there is no evidence that it was actually published pre-1964, or if it was published in what form, which is what is relevant for determining its copyright status. The book in question doesn't seem to even include the photo, let alone provide enough information to determine its copyright status. Brandt Luke Zorn (talk) 02:58, 25 July 2021 (UTC)[reply]
