The lotus symbol in this flag is a piece of art. Since the BJP was established around 1980, this symbol continues to be copyrighted under Indian copyright law. I cannot find any information about copyright with regards to the symbol on the party website. If you want to delete this file just because the lotus in the flag has been copyrighted under Indian copyright law, then the same would apply to all the Indian Political Party's flags that are uploaded on Commons. For instance, the flag of Indian National Congress, the flag of DMK, the flag of ADMK and the electoral symbol of BSP etc. are all copyrighted under Indian copyright law. But how is it that they are allowed to stay on Commons and not this? Is it not that they also infringe the copyright? Moreover, to the best of my knowledge, publicly licensed version of these flags and symbols are not available anywhere. So, the best we could do is to create an identical one for use in various wikimedia projects. But the design of the lotus in this flag is slightly different from the one officially registered and used by the party. There will be a few more lines below the lotus symbol in official version. So, this flag is not an exact replica of the official flag. Even more this file has not been copied from anywhere. It has been drawn by the uploader himself.
