According to the Spanish law, a work enter into the public domain 80 pma. This picture lacks any source information that allows to assess the conditions are met Stromare (talk) 08:03, 23 August 2013 (UTC)
- The license said that if the photo is 70 years old and the autor is unknow, no problem. Manuel Azaña died in 1939 and the autor is unknown. What is the problem?--EeuHP (talk) 21:36, 23 August 2013 (UTC)
The "problem" is:
- The license your use is wrong. A specific license tag covering the Spain case should be used instead.
- If so, you could acknowledge that the applicable law states 80 years pma and not 70 years pma (see Commons:Copyright_rules_by_territory#Spain). 70 years is only applicable since 1987. That's not the case of this photograph
- Being anonymous is not the same than not knowing the author.
So, it's your responsibility to assert that the author of the picture died before 1933. Otherwise, the precautionary principle applies. --Stromare (talk) 20:20, 25 August 2013 (UTC)
