No evidence file is in public domain, taken by a federal employee in the course of his duties. My understanding from dealing with other Scalia official portraits is that they are taken by private photographers and the copyright acquired by the government. I do not know who took this one, but the one by Mollie Isaacs is by a private photographer, see here and here.Wehwalt (talk) 13:51, 19 February 2016 (UTC)

- Keep It seems to be that he is an official photographer hired by the U.S. government. The photographer's LinkedIn page says "As Supreme Court Photographer, I create the official photographic record of the Justices and the visual history of the Supreme Court of the United States." Next time, please be certain and make sure a file is actually copyrighted before being overzealous and callous in trying to get it deleted. – Illegitimate Barrister 23:02, 19 February 2016 (UTC)
