As can be seen at the original source, this emblem was not designed by the US Army Institute of Heraldry but shows a Walt Disney character. So this is copyrighted and non-free. The Creative Commons licence is also outright false because if it had been a work by the Institute of Heraldry it would be public domain. De728631 (talk) 19:50, 14 May 2020 (UTC)[reply]

Creative commons is a result of a stray click and has been removed. I believe the issue is whether emblems that have been officially adopted by units of the US military fall under the provisions of 18 U.S.C. § 704, even if the original design was an outside source. 18 U.S.C. § 704 is about "Medals and Decorations" and it doesn't have anything to do with unit insignia. § 705 is about "Badge or medal of veterans’ organizations", and it prohibits the sale of insignia approved for veterans' organisations. Actually, it is interpreted to include emblems of the US military services. AFI 84-105 paragraph 3.5 discusses this, along with the implementing section of the Code of Federal Regulations. Ok, but an officially approved emblem still does not need to be public domain. Even if Disney or Warner Bros. gave their consent for the characters to be used in the official badges, it does not mean that anybody else can use them. De728631 (talk) 23:48, 18 May 2020 (UTC)[reply]
