This statue was made by Tōru Komuro. Komuro died on June 18, 1953. Therefore, under the United States copyright laws, the statue is presumed to be under copyright protection.
Files uploaded to Wikimedia Commons should be free both in the country of origin and in the United States, and possibly in other countries involved, either through being properly licensed by the copyright owner or being in the public domain. The United States copyright law does not allow free reproductions of non-architectural artistic works located in public spaces (this includes monuments and statues), so photographs of non-architectural modern artistic works are not considered as "free works" on Wikimedia Commons.
