Derivative work, no FOP in Ukraine. Erected in 1958 (according to uk.wikipedia), the memorial is not old enough to qualify as {{PD-Ukraine}}. Jafeluv (talk) 09:33, 23 October 2012 (UTC)

- Well, nobody is saying that it's PD-Ukraine. My point is that the photograph cannot be published under a free license unless the memorial itself is either PD or is also published under a free license. See COM:FOP#Ukraine. Jafeluv (talk) 10:16, 25 October 2012 (UTC)
- То до чого тут ліцензія {{PD-Ukraine}}, коли я публікую під ліцензією {{Cc-by-sa-3.0}}. А то, що в укрвікі адміни лізуть туди куди комар носа не підточить, то це вже їх справи. А вас я б попросив не йти на їх поводу. До того ж не думою, що це фото може бути дуже цінним що би його не можна було завантажить на склад. --Сіверян (talk) 14:12, 25 October 2012 (UTC)
- There are two copyrights to consider here: the copyright of the photographer, which is cc-by-sa-3.0 and there's of course nothing wrong with that, and the copyright of the memorial in the photograph. In some countries, copyright law allows taking photographs of buildings and/or artwork which is located on a public place, and publishing them under whatever license without worrying about the copyright of the depicted building or artwork. Unfortunately for us, however, Ukrainian copyright law contains no such exemption and so we can't host photographs of copyrighted monuments here on Commons. Please note that this deletion request is for Commons only, by the way – the image could still be hosted locally in a number of projects (including uk.wikipedia) which allow non-free use. - Ну якщо вже потрідно, то видаляй. Від цього втрачає лише проект вцілому. А перезавантажувати я не буду й не хочу. Якщо маєш бажання, то завантаж на руВікі, а в укрВікі воно вже є. --Сіверян (talk) 07:59, 26 October 2012 (UTC)

- Пояснюю для Сіверяна: більшість місцевих адміністраторів вважають, що в Україні нема свободи панорами. Нормальною мовою це означає, що при фотографуванні пам'ятника або споруди, архітектор/скульптор якого помер після 1951 року або ще живий, потрібний дозвіл від архітектора/скульптора, інакше порушуються його авторські права. Без такого дозволу вантажити сюди такі фото можна, але їх можуть знайти і вилучити (власне цілеспрямовано їх ніхто не шукає, якщо на них випадково натрапляють, то можуть номінувати на вилучення).--Anatoliy (talk) 12:00, 31 October 2012 (UTC)
