  •  Keep Publication according to the URAA and Berne agreements is when an image is "made public", not just published/republished in a book. "Made public" is when an image leaves the custody of the photographer and an image goes to the sitter. I could see a claim of unpublished if we had evidence that an image remained with a photographer and was never seen by a member of the public, or if we had specific Russian case law that narrowed the definition of "published". Some jurisdictions have clearly defined what published/unpublished means, but not Russia. --RAN (talk) 20:30, 3 January 2023 (UTC)[reply]
    • And there is no proof of that early enough here. No information about when or where a hypothetical early enough publication was. The burden of proof is on the uploader to specify exactly when, where, and how it was published early enough (ex, Magazine name issue #5 of year or Book title year & publisher) Not "lets assume it was published before the cutoff date because it's really old even though we have no idea of the when & where". Russian law is very clearly based on publication date, not creation date, so there is an obligation to prove there was an early enough publication--PlanespotterA320 (talk) 23:16, 3 January 2023 (UTC)[reply]

    • And there is still no evidence of this photo leaving photographer custody or being public pre cutoff date. Tell me exactly when (exact year), where and how it was legally published before the cutoff date if you can.
