According to available source, the photo was first published in a scientific article in 2017. Although it was created in about 1909, photographs of prisoners were not subject to publication (so it don't fall under the PD-RusEmpire exception), and the author of the photograph is unknown. Russian copyright law does not limit the term of copyright protection for unpublished works by unknown authors. Therefore, this photo is not in the public domain. Considering the publication in the scientific article legal, the photo is under copyright protection until 2088.--Yellow Horror (talk) 15:30, 26 May 2022 (UTC)[reply]
