While works of the federal government are presumed in the public domain under {{PD-US-Gov}} this does not extend to works of the several sovereign states. West Virginia does not release its intellectual property into the public domain by statute and I do not see any explicit release of this flag into the public domain at the source. - Delete: In addition to this flag not really being {{PD-USGov}} per en:WP:PD#US government works, it also seems to be a derivative work that incorporates photos that may separately be still under copyright protection of their own accord independent of the copyright status of the flag. This user's uploads previously were asked about at Commons:Village pump/Copyright/Archive/2022/09#Municipal flags and a more thorough examination of them may be needed because the user seems to be misunderstanding some things about COM:L. -- Marchjuly (talk) 05:36, 22 September 2022 (UTC)

- Comment as nom. The uploader has changed the claimed license to {{Pd-ineligible}}. There is very clearly original authorship in the flag; the selection of the phorographs which are compiled shows original authorship in their arrangement and is likely copyrightable as a collective work. — Red-tailed hawk (nest) 20:42, 22 September 2022 (UTC)

But note that while others are often kind enough to help on Commons, it is the responsibility of the uploader to show what they upload is free licensed. - Comment I note that the facebook link for source doesn't work. I didn't find that link, but a post about the flag is here on the facebook page for the "The Town of Chapmanville Beautification Commitee". It states "The Town of Chapmanville Flag contest that was hosted by The Chapmanville Beautification Committee and The Town of Chapmanville was Harlea Abraham". So the flag is a recent creation, author is Harlea Abraham. Presumably the author maintains rights, and even if they transferred those rights to either the Beautification Committee or the town government, there is no reason to think this is free licensed. -- Infrogmation of New Orleans (talk) 17:41, 28 September 2022 (UTC)
Deleted: With more consideration of above, deleted, from all indications this is NOT free licensed. Three different licenses have been slapped on to this image, all of which were provably false - if the flag "contains no original authorship" as the most recent tag claimed, the author would not have been awarded a prize at a public ceremony. --Infrogmation of New Orleans (talk) 17:47, 28 September 2022 (UTC)
