Freedom of panorama is absent in the United States. While this is a graffito, the artist w:en:Revok is one of the litigious US graffiti artists, and he has successfully tamed one commercial user (H&M), to agree on a settlement in his favor (see this and this, regarding H&M's use of a Brooklyn graffito by Revok in an ad campaign).
