The advertisement in the lower right was added, and should not be there. The actual security camera footage is likely a work of the Spanish Government, and may in fact be fair game. 70.36.136.117 08:41, 26 July 2013 (UTC)[reply]
Delete The security camera footage is probably from the owner of the track, which may or may not be the Spanish government. Until it can be established who created the security camera footage, and whether it is freely licensed, we must assume that this image is a copyvio. If it's not a copyvio, then the image should be recreated without the advertisement. —Psychonaut (talk) 09:06, 26 July 2013 (UTC)[reply]
The original video, which is currently visible on YouTube entitled "Grabación accidente de Tren Galicia" actually has the date/time encrusted in the lower right corner. So the advertisment for GIFSOUP.COM is now hiding this most useful detail!!! --Neil.dewhurst (talk) 09:09, 26 July 2013 (UTC)[reply]

Comment In the UK, footage from security cameras is not copyrightable. I don't know for certain, but I would think that a similar situation would aspply across the rest of the EU. Mjroots (talk) 09:54, 26 July 2013 (UTC)[reply]

I'd have said that placing a security camera at a certain place and angle is just as much a creative work as taking a photo from a certain place and angle. But perhaps I'm wrong. darkweasel94 10:44, 26 July 2013 (UTC)[reply]

Keep per the YouTube link. Some accident could've occurred in the uploading, etc. WorldTraveller101 11:39, 26 July 2013 (UTC)[reply]

Delete and recreate/reupload without advertising if it is established that the source images are not copyrightable. ~ trialsanderrors (talk) 11:59, 26 July 2013 (UTC)[reply]

Deleted: The file was already speedy-deleted by User:Jcb under the rationale "This is a RENFE railside camera image leaked to the media without permission. Obviously not PD, not even offically released by RENFE". whym (talk) 00:16, 3 August 2013 (UTC)[reply]
