Blitz2
[edit]Image:StPaulBlitz.jpg: This image was deleted after a DR (Commons:Deletion requests/Image:StPaulBlitz.jpg), but then restored again. It should be deleted again. Within the EU, a copyright term of 70 years applies in general. See here for the gory details. The photo was taken on 1940-12-29 and published on 1940-12-31 on the front page of the UK newspaper Daily Mail. The photographer of this image, Daily Mail staff photographer Herbert Mason, died in 1964, so this photo will enter the public domain in the UK only in 2035. Lupo 13:28, 27 September 2008 (UTC)
- P.S.: Category:The Blitz has a number of photos from the Imperial War Museum collections. These appear to be ok, as they were taken by offical War Office photographers and were thus covered by Crown Copyright, and we treat expiry of Crown Copyright to apply worldwide. The rest are one LOC image (ok, too, the photographer, Ms. Toni Frissell, donated the images to the public domain) and a number of NARA images, which may or may not be ok. - Delete My restoration of this after the last DR was a mistake. Although copyright in the UK did expire, it was later restored by the Duration of Copyright and Rights in Performances Regulations 1995 (implementing the EU Term Directive). At that date, this image was protected in Germany for a period of 70 years pma, and the 1995 regulations restored the copyright to bring the UK period up to 70 years pma as well. Crown copyright cannot apply, as the author at the time of taking the image was a newspaper reporter not a member of the armed services. --MichaelMaggs (talk) 06:18, 29 September 2008 (UTC)
- Move This image is under copyright and should be deleted from Commons. However, this particular image is an iconic photograph of St Paul's cathedral during the Blitz; and should be maintained on wikipedia at those two articles with appropriate fair use rationales.--72.218.101.125 19:14, 18 October 2008 (UTC) bennyfactor
- Keep NARA says]: "Use: No restrictions". They are selling copies. I do not see any need to be more reverent of copyright than this branch of the US Government. /Pieter Kuiper (talk) 18:33, 26 November 2008 (UTC)
- Unfortunately that doesn't address the fact that the image is still copyright in the UK. --MichaelMaggs (talk) 20:07, 26 November 2008 (UTC)
- Move back to wikipedia to support the linking articles - with full fair use rationale. Although it might be worthwhile checking if the photographer was an accredited war correspondent; in which case, he was de facto, a member of the armed forces. Any doubt in the matter needs to err on the side of caution. Kbthompson (talk) 18:40, 24 March 2009 (UTC)
