- Artist identified for File:Gaucho Latinoamericano.jpg, alternate version found for File:Baron del triunfo.jpg (c. 1903). While the original uploader failed to provide accurate author, source, etc., information. A little work with Google Lens found those two relatively quickly. Recommend keeping those that can be identified rather than mass deleting.
On their face, most of the paintings appear likely to meet {{PD-old-auto-expired}}.The photographs are more problematic. —Tcr25 (talk) 14:52, 11 May 2023 (UTC)- Running quickly through the paintings, File:Gral. Paunero.jpg
can probably benow properly sourced. File:Gral. Bernardino Caballero retrato 2.jpg is likely too recent (c. 1960) to be used without more information. The rest will require more work. —Tcr25 (talk)

This file was initially tagged by Ippantekina as Copyvio (copyvio) and the most recent rationale was: File source (https://www.hillsboroughcounty.org/en/newsroom/2023/04/07/the-eras-tour-hillsboroughs-version) does not indicate a CC license, presumably copyrighted. CC license is incorrect and I see no evidence of it, but Florida releases public records into the public domain, so there's a non-trivial chance that this is {{PD-Florida}} and a speedy has to be declined. My worry with that is the copyright status of the set of images and the dome on the left side; they seem greater-than-de minimis, but I can't find their original publications nor the source information for them. — Red-tailed hawk (nest) 05:02, 8 May 2023 (UTC)

I doubt that this file was taken by the uploader.
The EXIF info says "Software used: Picasa", it was uploaded by a hit-and-run account (an account that uploads only one file that seems to be a copyvio) and the image can be found on Google Lens and TinEye with the copyright notice "© Helmut Wimmer"
Maybe the uploader @Meisterklasse.a: can tell use more about this --D-Kuru (talk) 05:50, 8 May 2023 (UTC)
- Hi @D-Kuru! I'm not a "hit-and-run" Guy. Yes, the picture was taken by Helmut Wimmer and he waved the rights. Meisterklasse.a (talk) 10:22, 9 May 2023 (UTC)
- @Meisterklasse.a: Thanks for your reply. How did Helmut Wimmer exactly wave the rights? Did he publish it under a free licence (If so: Where)? Is there any source that proofs the claim that he published it under CC-BY-SA-4.0? And when did you become the author (author=Meisterklasse.a)?
- On I'm not a "hit-and-run" Guy - You are maybe not, but your account checks all the suspicious marks that usually only those accounts do that are used to only upload copyrighted material. Your reply is the first indication that you could be the exception from the general rule.
- --D-Kuru (talk) 16:51, 9 May 2023 (UTC)
- Hi @D-Kuru! Thank you for your reply and the explanation. It's always good to be an exception. Is it the best and easiest way to reupload the file including the necessary statement from Helmut Wimmer? Meisterklasse.a (talk) 09:48, 15 May 2023 (UTC)
- @Meisterklasse.a: On Wikimedia Commons file description and their licencing have to be accurate. Example: If you are not the original author information like "Source=Own work" and "Author=Meisterklasse.a" is just plain wrong.
- The important information is: Where did you get the file from (source)? Who is the real author? Under which licence was this file published? How did the author licence the file? Do you have a written permission or did he just give you the permission verbally? Is there any proof that what you claim is true? You have to understand that basically everybody could tell us anything on Commons and even we act in good faith there is a clear border to being stupidly naive. You are maybe a real human, but for all what's worth there is no indication for me or anybody else that you are not a bot based on ChatGPT. You also have to know that on Wikimedia Commons every file should be usable for any purpose including commercial use. So we have to demand a certain level of trustworthiness.
- --D-Kuru (talk) 19:49, 15 May 2023 (UTC)
- Hi @D-Kuru! I fully understand and agree. As mentioned, I'll reupload the file and already sent the written permission to permissions-de@wikimedia.org. Thank you for your support! Meisterklasse.a (talk) 15:37, 1 June 2023 (UTC)

we have a new logo and would like to create a new wikipedia page with our new logo for our whole group TMS Marketing (talk) 14:02, 8 May 2023 (UTC)
- Question What is the deletion reason? We don't delete old logos. -- Ikan Kekek (talk) 02:26, 9 May 2023 (UTC)
- we have a new logo and the old one is no more valid. Currently we are cleaning up all the old logos from the internet and would also like to create a new Wikipedia page. We don't want to confuse the visitors. 83.164.143.164 13:29, 16 May 2023 (UTC)
- As I said, that is not a deletion reason. However, a likely result is for none of your logos to be hosted by this site because of a belief that logos have no educational value or that your company is not notable. Is there currently a Wikipedia page for TMS Marketing in any language? -- Ikan Kekek (talk) 20:47, 16 May 2023 (UTC)

How do you know, that the photographer is 70 years dead? For 1920 photos this is not obvious. Also the license claims publication before 1928 – how do you know that? Taivo (talk) 07:50, 8 May 2023 (UTC)
- Keep First of all, how do you know they aren't? This photograph was taken in Malta exile and anonymous since, as it can be seen from the copy, bears no insignia of photographer.
Secondly, you say that how you can prove that this was used before 1928. 1928-9 was the period of Turkish language-alphabet reform, thus it would have been rather hard for detect to some random photograph. However, this is one the most famous portraits of him, and, as it can be seen from the publication Resimli Ay, was published as late as 1924, the year of his death. (Tashrin-i Sânî ["Second Tashrin", November] 1924)
Questioning things is a good habit, but I believe requires few conditions: 1) Having a base to build your views over it. 2) Not being rude, and using a logical but courteous language. Your type of questioning lacks from both. Maybe next time you may consider doing some research before questioning and requesting a deletion offer. Especially considering that it's related with Turkey and Turkish, with a language and literature even to a degree unknown to foreign language studies. Beyaz Deriili (talk) 00:19, 11 May 2023 (UTC) - Keep Per Beyaz Deriili. Gökalp died in 1924, so publication prior to 1928 is a reasonable assumption for this sort of portrait. —Tcr25 (talk) 14:55, 28 May 2023 (UTC)
- I disagree. The claim of anonymous work is not obvious and needs evidence. Also claim, that the photo was published during his lifetime, needs evidence as well. Taivo (talk) 15:42, 28 May 2023 (UTC)
- The image from Resimli Ay (en) that's linked above is a vignette of the same image (Here is a clearer PDF version that can be examined more closely.) The issue is dated "Teşrin-i Sânî 1340", which is using the Rumi calendar, but lines up with November 1924. The article is an obituary for Gökalp, who died in late October 1924. This should satisfy the question about at least a version of the photo being published prior to 1928, which would make {{PD-old-assumed-expired}} a possible valid license. As to whether or not the photographer can be determined, there's not one listed as best I can tell with the Resimli Ay printing, nor is one listed in any of the many instances where this picture or a version of it is popping up in searches. That's not definitive proof that the photographer cannot be known, but it doesn't appear to be attributed anywhere, which would make {{PD-Turkey}} valid. —Tcr25 (talk) 18:33, 28 May 2023 (UTC)
- Additional data point supporting PD and anonymous photographer: A version of this image is used on the cover of Competing Ideologies in the Late Ottoman Empire and Early Turkish Republic, and the publisher (Bloomsbury) credits the photo to "Historic Collection / Alamy Stock Photo". Alamy Stock clearly lists the photo as being a historic image in the public domain. —Tcr25 (talk) 11:14, 31 May 2023 (UTC)
- How it's not obvious? I have provided a clear use of it, thus making it and its variants public domain. Why do you neglect my comment, and respond to someone other? How is this act is good faith?

- Any artistic sculpture or model is art. The reason why we have many such images up is simply that they're constantly uploaded faster than they can be detected. But some such exhibits are old enough to be in the public domain due to age. FunkMonk (talk) 03:15, 14 May 2023 (UTC)

This file was initially tagged by Cakelot1 as Copyvio (copyvio) and the most recent rationale was: Somebody saying that there "fans and creators are allowed" to do something is not the same as releasing content under a free licence. There is no legal underpinning to what is claimed here and can't be excepted on commons. The video in question is not released under youtube CC and there is no indication of actual free-licence being in play. King of ♥ ♦ ♣ ♠ 22:57, 8 May 2023 (UTC)
- Comment See prior discussion at Special:Permalink/760942817#File:Ethan Klein 2023.jpg. -- King of ♥ ♦ ♣ ♠ 23:00, 8 May 2023 (UTC)
- No actual licence was provided. Klein didn't agree to legal restrictions that you have to when you put content under a free licence. He didn't agree to the terms of the CCBY4.0 licence ([3]). Particularly, there is nothing legally preventing him from changing his mind and taking down reuses he doesn't like in the future, thus it is non-free. The explicit rights given to re-users is why we require proper Licensing. Cakelot1 (talk) 23:20, 8 May 2023 (UTC)
- Comment I'm copying the discussion from User talk:Kdog5454 below (Cakelot1 (talk) 23:24, 8 May 2023 (UTC)):
- Saying “fans and creators” was perhaps a bit more hyperbolic and worded just to sound more intelligent than it should have been. It is entirely free to use, as stated by Klein. In early January he stated “… I am opening our IP (intellectual property) to the world… If you want to [use]… anything with me in it… go for it man. Monetize it. I will not claim, I will not remove, I will not do anything.” Evidence of this can be seen in this clip from an episode of the podcast which predates the screengrab: https://youtube.com/q2GGi9hbrZo
- There is sufficient evidence of the free license being sufficient here. Thank you for reading!! Kdog5454 (talk) 18:35, 8 May 2023 (UTC)
- No, we need it to be legally licenced under a free licence. While it's very nice that the creator says that anybody can use it, if it's not actually licenced under a free licence then there is nothing legally preventing the creator going back on there word at any point. Commons requires that anybody be able to use files even if the creator wants to prevent (so long as they follow the listed restrictions). There is no such legally enforceable guarantee here.
- You can't just assume that the creator is fine with everything in the licence you've arbitrarily chosen (https://creativecommons.org/licenses/by/4.0/legalcode). Again these are legally binding contracts not half thrown off platitudes. If you want the image kept I suggest you get the actual copyright holder to release it under an actual free licence via COM:VRT Cakelot1 (talk) 23:14, 8 May 2023 (UTC)
Delete First, it is not irrevocable -- he can change his mind at any time. Commons requires "The license must be perpetual (non-expiring) and non-revocable." -- see COM:L
Second, he clearly calls for use only as "clips" -- the whole works are not free. It's also unclear exactly what works it applies to.
Third, and most important, copyright licenses must be in writing. The video statements have no legal status. . Jim . . . (Jameslwoodward) (talk to me) 14:20, 9 May 2023 (UTC)
- Per Implied license#Express license, non-exclusive oral licenses are allowed -- just not exclusive licenses (as those are effectively a transfer of at least part of a copyright). I'm also OK on the revocable front; he's expressly encouraging people to make money off that work, and to revoke a license like that without stating it's revocable could, I think, open himself up to damages (if it's even allowed, which I'm doubtful of, as it was not expressly revocable). The danger to me is what, exactly, the permission is for -- they clearly allow the use of highlight clips, but does the permission extend beyond that. They expressly say that uploading entire videos is not allowed, so there are some limitations. Could a screen grab be considered a very short clip? I could see that. Do they allow different types of derivative works, or just embedding clips into other videos? It's in that area, the scope of the given license, where it gets harder with these off-the-cuff licenses. Carl Lindberg (talk) 09:43, 10 May 2023 (UTC)
Delete Erring on the side of caution would indicate deletion as the safest option per COM:Precautionary principle. Also I may have hastily added speedy delete tag to a file of a similar nature (File:Hila Klein 2023.jpg). Pabsoluterince (talk) 00:22, 7 August 2023 (UTC)
Delete saying you won't go after users if they reuse your material under some not clearly delimited conditions (whole videos are clearly forbidden) is far from the formalities we require in COM:L to cover the back of our users. If they really meant CC-BY, then they can add it to the YT videos. Günther Frager (talk) 01:14, 7 August 2023 (UTC)

This file was initially tagged by Nikkimaria as no permission (No permission since 30 April 2023). The file is a scan of a newspaper entry that was published in Oklahoma during 1954, meaning that {{PD-US-not-renewed}} is possible if the copyright on the collective work was not renewed. Has anybody checked the renewal records on this? — Red-tailed hawk (nest) 00:59, 8 May 2023 (UTC)
- Keep Deletion requests should be reserved for when you have determined that there is no renewal, not for speculation that there may be no renewal. Anyone can look up renewals themselves, and Online Books, which we link to, has all the publications that have renewed, and the start date for renewed issues. If we do not have an entry for Online Books, for that publication, there were no renewals at all. If you do not understand the concepts or procedures, you should ask at the Village Pump, rather than dive into the speedy deletion process. The Oklahoman did not renew any individual articles, or any issues. Thank you to Red-tailed_hawk for spotting this incorrect speedy deletion. --RAN (talk) 01:19, 8 May 2023 (UTC)
- To clarify, I generally wouldn't open a deletion request myself to speculate on whether or not a source was renewed; my reasoning for opening this was to contest the speedy tag as being deficient. — Red-tailed hawk (nest) 02:34, 8 May 2023 (UTC)

This file was initially tagged by ManFromNord as no permission (No permission since 30 April 2023). The present license is probably wrong, but there's a good chance this photograph is in the public domain. This photo (per the uploader) is from 1958, which would make it eligible for {{PD-US-not-renewed}} if copyright was not renewed. Furthermore, this looks a lot like a hollywood publicity photograph, a genre of photographs frequently issued without valid copyright notice (see: {{PD-US-no-notice}}). - The question on this (and similar cases) is going to come down to:
- When was the model made?
- If recently enough to still be in copyright, is there enough in the model that is not simply faithful reproduction of what it represents to be copyrightable?
- - Jmabel ! talk 14:34, 8 May 2023 (UTC)
- It looks like the creator of the model is not named. [4][5] Edo-Tokyo Museum opened around 1990.[6] It seems reasonable to assume that the model (which is permanently displayed) was created at the same time, commissioned by the museum. As for how much of it is a faithful reproduction of publid domain works, the buildings in it, assuming they were reproduction of real buildings, are likely to be public domain. However, the human figures and the carriages seem less likely. whym (talk) 11:35, 16 May 2023 (UTC)

- The question on this (and similar cases) is going to come down to:
- When was the model made?
- If recently enough to still be in copyright:
- What is the Japanese status of clothing in terms of copyright, and is any of the clothing here recent enough for that to be an issue?
- is there enough in the model that is not simply clothing and minimal mannikins (not usually copyrightable, though I don't know about Japan) to be copyrightable?

- This is a poor-quality version of the shield portion of File:Provincia di Pavia-Stemma.svg in a rectangular shape. I have no idea if this "flag" was ever actually used, and it's possible this was downloaded from the web somewhere, but I think we can make a new version of this from the COA image and that would work as a replacement, if someone wants to tackle that. - This is File:Sestri Levante Coat of arms 2.png on a white rectangle which is then tied to a spear like a flag, so that would make the flag image a flag itself, which is weird. If we look at this image (non-direct link), we can see in the bottom right it says "Nottingham Journal Ltd". Since this was published in 1936, COM:COMM UK states that this is IP of the commisioner (i.e., the Nottingham Journal). Since this is a company, it expires 70 years after publication, so it expired in 2006. However, this means URAA applies. Commons is not censored, so this instruction to censor certain images (so far exclusively applied to images of Muhammad, as far as I can see) is inappropriate. Further, when users view this image on aother wiki, it gives them specific instructions which may violate local policies - Commons should not include usage instructions which are not universally applicable. WJ94 (talk) 14:31, 8 May 2023 (UTC)
- Keep: In use on 25 file pages. No censoring but providing a choice. --Achim55 (talk) 15:01, 8 May 2023 (UTC)
- Keep: This template explains how users can hide the image for themselves, not censoring it for others. Also, I don't know what local policies you are refering to. As far as I know there are no policies that are being broken. --Rock3003 (talk) 15:34, 8 May 2023 (UTC)
- This template does not explain how users can hide the image for themselves. It instructs users to please include
<div class="{{{code}}}">
before the image and</div>
after the image when adding the image to articles. The requirement to include such parameters on certain images (such as images of Muhammad) is a policy issue which should be decided by local wikis rather than a template placed on the image at Commons. For example, on the English Wikipedia, doing so may conflict with the no disclaimers guideline. I have no opinion on whether a parameter like this should be added to depictions of Muhammad, but whether or not that should be done ought to be a decision made by local communities and this template undermines that. WJ94 (talk) 15:54, 8 May 2023 (UTC)- Your argument seems good to me, so I would tend to favor deletion, too, but maybe someone could explain how this template does not violate policies. -- Ikan Kekek (talk) 02:25, 9 May 2023 (UTC)
- I don't see this as being a disclaimer, it's instructions. And generally the disclaimer policy applies to articles, not pictures. Maybe it can be rewritten so that it be more optional. Instead of saying "please" it could say "you could". And adding a link to how users can use the code. --Rock3003 (talk) 09:05, 10 May 2023 (UTC)
- This template does not explain how users can hide the image for themselves. It instructs users to please include
- Delete: Since this template mandates users to apply specific codes directly to the local wiki articles, this can't even be considered a disclaimer nor even a choice; once the code is applied directly to the article, it's there for everyone; and some random users have no right to dictate rules on local wikis, their communities should be the only ones in charge of these choices. I hence suggest to also delete the said code from all articles it has been added to. Daniele Fisichella 03:48, 1 July 2023 (UTC)

Fantasy design that has never been used or adopted in any form. It has no educational value and should not be used in any article. Calling it "unofficial" is stretching the truth, which should be for things widely used but not adopted by law. I can't just make up random flags and expect them to be used just because there's a disclaimer that it's "unofficial"! Reywas92 (talk) 15:37, 8 May 2023 (UTC)
- Keep As per 1, 2 & 3, the designer was a member of the Fish & Wildlife Service, which oversees the islands. They were not just a random person, but someone who is part of the authority maintaining the islands. I think the name of the file containing "Unofficial" and the use of Template:fictional flag is enough to signify the file's unofficiality. No Lives Left ⸞NᴇᴡTᴀʟᴋ⸟ 04:19, 12 May 2023 (UTC)
- So what? Just because he's an employee means NOTHING. I work for a state government agency, and we don't have a flag, but that doesn't mean I can just make one up for the agency or anything we oversee and pretend it should be used or even merely called "unofficial." The source even says "Actually a well thought out and simple plan and although everyone in his office was supportive of his design his boss thought it was a waste of time and the flag design came to an end. The designer was with the Fish and Wildlife service his name was either Mark or Mike." Even if my colleages support me, I'm still just a random person with no authority unless someone higher up approves it. The FWS is huge, and we don't even know who this is or if his job had anything to do with these islands – it's still just a fantasy design that has not been recognized or used in an appropriately relevant fashion. Again, this has no educational purpose and should never be used on any Wiki project, misleadingly suggesting it's used or recognized, so it should be deleted. Reywas92 (talk) 23:14, 12 May 2023 (UTC)
- Would a rename to that specifies that this file is the flag used at the USS Arizona Memorial suffice as a compromise? Moving it to File:USS Arizona Memorial flag for Howland–Baker–Jarvis, File:Flag used for Howland–Baker–Jarvis at USS Arizona Memorial, or something similar would allow it to be used in the context of the memorial but is enough to show the flag isn't very widespread in use elsewhere. 149.75.65.56 05:46, 13 May 2023 (UTC)
- Um, when was this used at the Arizona Memorial??? Reywas92 (talk) 22:32, 13 May 2023 (UTC)
- It wasn't used at the memorial, but as per fotw, the flag was made mostly to be added to digital archives. It was originally approved to be released as the unofficial flag and going to be announced, but the announcement was cancelled because they thought making an announcement for something unofficial didn't make much sense. If anything, a move to "proposed flag for Howland–Baker–Jarvis" might make more sense. I think the filename containing "unofficial" or "proposed" in addition to the existing Template:fictional flag is enough to specify that the flag isn't official without needing to delete the file or add more unnecessary text to the file's description (as Reywas92 has). No Lives Left ⸞NᴇᴡTᴀʟᴋ⸟ 00:48, 16 May 2023 (UTC)
- Right, that doesn't "make much sense". I like flags as much as the next guy, but fantasy proposals fail Commons:Deletion_policy#Not_educationally_useful. And that link is for Kingman, not this design. Reywas92 (talk) 14:07, 16 May 2023 (UTC)
- I must add that the flags were not used in the memorial as it is explained in the 208th Release of NAVA News: "Three other islands in the Pacific are under the jurisdiction of the U.S. Fish & Wildlife Service. Baker, Howland, and Jarvis Islands were supposed to have a flag designed, but as far as I know, that never happened. I used the current Dept. of Interior flag to represent those three islands." Nevertheless, the article also shows how the designs for the other territories were actually made into real flags. Follow-up on the unofficial design for Howland, Baker, and Jarvis Islands was then provided by the same author on FOTW. I believe the best course of action to settle the debate would be to contact Skip Wheeler and ask if these flag design was ever printed or used, and if there is evidence of such use. Germenfer (talk) 17:10, 17 May 2023 (UTC)
- Again, I cannot emphasize enough: this is not a real flag, it has never been recognized or flown in any sanctioned capacity, and it should never be presented with any legitimacy whatsoever. A flag enthusiast was in correspondence with the person who made it up and with the FOTW website, but that does not mean it has educational value or should be used on Wiki projects. I cannot find anything else about Skip Wheeler online so that may be difficult and unreliable, but even if he had it printed, it has no proper use on Wiki. Reywas92 (talk) 03:53, 6 June 2023 (UTC)

I believe the best course of action to settle the debate would be to contact Skip Wheeler and ask if these flag design was ever printed or used, and if there is evidence of such use.
- Um, when was this used at the Arizona Memorial??? Reywas92 (talk) 22:32, 13 May 2023 (UTC)
Reywas92 (talk) 23:14, 12 May 2023 (UTC)

there are no evidences to prove this photo was taken by Mehr News Agency. it is a photo used by Mehr and not taken by that website. NameGame (talk) 05:32, 8 May 2023 (UTC)
- Keep: Do you have any information to the contrary? The image appears to be solely hosted on Iranian sites, and is clearly posted at Mehr news which declares all of its content to be "licensed under a Creative Commons Attribution 4.0 International License." Prove otherwise. Aetius (talk) 08:18, 8 May 2023 (UTC)
- they only own the pictures of themselves which have been taken by their photographers and they prove it by watermarking photographers' name on images. I am a native Persian and as I read it, that page has not been written about owning this image by Mehr News or at least one of their photographers.
- These below listed websites have used this image as "Mehr News" does:
- & if you do search his name in his native language, (Arabic: خضر عدنان), you will be viewing more of this used image. NameGame (talk) 01:17, 9 May 2023 (UTC)
- Keep Per Mehr_News_Agency#International_cooperation, the agency has multiple international cooperation agreements in place which would surely not be tenable if the website made a habit of putting others' images under their own CC4.0 license. Onceinawhile (talk) 09:05, 8 May 2023 (UTC)
- I dont think this is taken by Mehr, this seems to be a screengrab from some network. An Israeli paper uses it and attributes it to "Arab networks" (here). In fact I dont think you should be using images from Mehr at all, they use images without attribution they clearly did not take. Like here (with the UN logo still on it and not cropped out). In sum, delete as being from unknown provenance with a shaky claim by the supposed CC licensor to actually own the content. Nableezy (talk)
Deleted: Per nomination and discussion. Iranian news agency photos are only reliable <with free licences> when they have the watermark of the agency and the name of the photographer on the photo itself. Keep. Commons:Copyright rules by territory/Italy gives government works 20 years of protection before they enter PD. This city logo design has existed since at least 21 years ago, so by now, the logo design should already be part of PD. 痛Designism (talk) 21:51, 11 June 2023 (UTC)
- Has this logo existed since the 1970s? It appears to be public domain in Italy, but what about the US? Abzeronow (talk) 16:55, 3 October 2023 (UTC)
Comment The shield used in the centre was speedily-deleted by Yann on May 1st, and the copyright claim status of the composite flag should clearly follow that of the shield. So the first question would be whether that was freely drawn up from a blazon, and if not, what precise image it would have been derivative of. But if the coat of arms stays deleted, then would be silly to keep the flag. Felix QW (talk) 20:16, 8 October 2023 (UTC)

- No! This may be unofficial, but it is not fake. It has been recorded on the website of FOTW. 170.235.204.49 16:44, 2 June 2023 (UTC)
- And I would be very happy to decline that if I was an administrator. 170.235.204.49 16:46, 2 June 2023 (UTC)
- FOTW isn't a reliable source. Again, I cannot emphasize enough: this isn't a real flag, it has never been recognized or flown in any sanctioned capacity, and it should never be presented with any legitimacy whatsoever. A flag enthusiast was in correspondence with the person who made it up and with the FOTW website, but that doesn't mean it has educational value or should be used on Wiki projects. According to Commons:Fan Art § Re-drawing does not avoid copyright infringement,
It is important to understand that you do not avoid copyright infringement merely by re-drawing an existing copyright work, even if you introduce artistic additions or embellishments of your own. For example, if you redraw the map illustrations depicted in the novel The Lord of the Rings you infringe their copyright just as certainly as if you had photocopied them.
These maps listed here are maps of A Song of Ice and Fire / Game of Thrones. --痛Designism (talk) 12:33, 8 May 2023 (UTC)
- Keep: In most jurisdictions, re-drawing does avoid copyright infringement, but yeah, most doesn't mean all. That's fair use, IMHO... anyway, if they're found uneligible, I would suggest to move these valutable files to en.wiki instead of completely losing them. Est. 2021 (talk) 13:01, 14 May 2023 (UTC)
- Fair use has never been allowed on Commons. But yeah, I do think there's value in moving the files to Enwiki.--痛Designism (talk) 16:12, 14 May 2023 (UTC)
- Note that most of these pictures are from A Wiki of Ice and Fire, where they are licensed under CC BY-SA 3.0. In addition, since you shared a quote about The Lord of the Rings, note that Commons already hosts hundreds of maps of fictional places, including maps of Middle-earth. Est. 2021 (talk) 13:08, 14 May 2023 (UTC)
- Uploading from that Wiki is effectively Commons:License laundering. And yes, those suspicious fiction maps based on fictional worlds should also be removed. --痛Designism (talk) 16:12, 14 May 2023 (UTC)
- Keep At least for some of them. To my knowledge redrawing, recreating or drawing alike (in particular of 2d) is not a copyright violation in general as pointed out above. I'm not sure whether it makes sense to require it not being an potential infringement in any conceivable jurisdiction. In other cases Commons usually keeps everything which is at least not an infringement with a warning label of jurisdiction that differ. Also it seems to me instead of list this needs to be done on a case by case basis. The redrawing/recreating issue is completely different from the license laundering issue. The latter requires no deletion but just an according adjustment of the licenses.Kmhkmh (talk) 04:04, 5 October 2023 (UTC)
- "redrawing, recreating or drawing alike (in particular of 2d) is not a copyright violation in general" it depends on the fidelity and local law. Tracing images with pencil in a library might be ok, but making a detailed SVG map is beyond innocent for me. -- 痛Designism (talk) 22:07, 6 October 2023 (UTC)
- This has nothing to do with "innocence" or supposed "bad intent" or whatever, but that is many jurisdictions such 2D reproductions are not a copyright infringement (and not everybody reads all commons policies before uploading something he assumes to be appropriate anyhow). Now if all of these maps indeed seem to be reproductions or are based on reproductions of a drawing that was published elsewhere under a share alike licence, then imho easiest and least disruptive solution is to adjust the licences accordingly here. I don't really see a reason for deleting anything.--Kmhkmh (talk) 21:23, 10 October 2023 (UTC)

- Delete. These maps are clearly derivative works. Perhaps this is allowed in some jurisdictions, but according to the Commons policies, these works are not accepted per COM:Derivative works. These maps could be based on https://quartermaester.info/ where it is stated (please press the "i" for information) Intellectual property of A Song of Ice and Fire, this map and all locations belong to George R.R. Martin. The maps might also be derived from the book The Lands of Ice and Fire (A Game of Thrones), which is copyrighted as well. Consequently, these files have to be deleted imho.
