This flag was created by a user of the subreddit and discord server of "r/vexillology" by the name of Vulpes as a personal symbol. It was not designed with the intent of being a fascist symbol, and the continued use of it as such on Commons contributes to the misappropriation of this user's personal flag. Di (they-them) (talk) 02:38, 11 May 2021 (UTC)
- Comment The user who published this copyvio likely did not know of its actual status, as users on the Fandom website this Wikipedia file names as a source are required to confirm that uploaded work is copy-right free. This is a failure on that external site's part. It should probably be removed from Wikipedia, but it would be good to have the actual copyright holder confirm. Firstly, there is no COM:FOP for sculptures in the US, so on this basis it is a copyvio. Additionally, the monument is not a work of the US government but of a private foundation, which had to be pay licencing fees for the use of MLK's image and copyrighted quotes on the memorial. Unfortunately, all of the photos in this nomination are not free for hosting on Commons.

- I was a contributor for many of the original images, including photos I had taken myself. All of my photos were deleted, which helped me learn about the rule against publicly displayed works of art. At that point, I added only photos that were included in official U.S. Government websites (primarily, the U.S. Park Service site). I am quick to say I am not an expert, but try to learn, but I did have a conversation with one of the image experts at wikimedia commons who thought that using images from the government sites would be all right. Since then, I do see that some "original" photos by others have been added (including the one in the info box), with the U.S. Government photo I had put there moved to the gallery. I appreciate this editor's efforts to ensure that the photos that remain are allowed. If it turns out that even photos taken from official U.S. government sites are not allowed, then I will learn more.... NearTheZoo (talk) 12:48, 17 March 2012 (UTC)
- I'm afraid that the issue is that you need permission from both the sculptor (or whoever the copyright holder of the sculpture may be) and the photographer. The {{PD-USGov}} template only confirms that you have permission from the photographer, but you still lack permission from the sculptor. I hate it when images are deleted because of lack of FOP, but as I see it, there is nothing that can be done here. At least the US situation is much better than the French situation where you can't even take photos of recent houses... --Stefan4 (talk) 13:48, 17 March 2012 (UTC)

- It's my understanding that the memorial is managed by the National Park Service, however, it's not the result of a federal government work. It's a bit of bummer that the memorial is like this. If there are images that are needed for use on articles on WP under non-free criteria, I would suggest grabbing them and uploading them to local projects under the NFCC if they can be use and comply with relevant criterias. russavia (talk) 13:43, 17 March 2012 (UTC)
- Quite frankly, I am sick of Wikipedia editors crippling the mission and functionality of Wikipedia by going around and nominating images, such as those listed above, for deletion out of bogus copyright infringement claims. First of all, the entire site and all of it's contents are owned by the Federal Government of the United States, in the context of this memorial, it is not that NPS allowed a private foundation to place their memorial in this location and now acts as its custodian. The memorial was authorized by congress, was paid for with private funding, and upon completion, was turned back over to be managed by the NPS. I have never seen any claims of copyright by the sculpture of the main statue, nor have I seen such claims from the stone masons who carved all the text. The rampant deleting of such images is pathetic, and seem to cripple the encyclopedic functionality of this entire site. Above all else, these images would be considered fair use no matter their resolution as they are not being used for any monetary gain and are used for educational purposes. I would like to know why it is that someone decided to start caring so much about the MLK memorial that they are always deleting images, but conveniently ignore the plethora of other DC Memorial (installed post 1978) pictures throughout Wikipedia. Better get on the case, I see some pictures over on the Korean War Memorial page that Frank Gaylord might want Wikipedia to pay for! </rant> Something Original (talk)

Keep- As the owner and operator of the memorial under Commemorative Works Act (40 USC 89) the United States government has widely published noncopyrightable images of portions of the memorial. Such acts being completely contrary to any claim of copyright, especially the assumed, unsubstantiated and inchoate claims that no one with any authority or reference has shown exist, the files are completely in the public domain. Alanscottwalker (talk) 13:35, 28 May 2012 (UTC)- Copyright or not depends on the creator of the memorial, not the owner/operator of it. - Keep. I can't imagine that the owner of the statue's copyright (who is this, by the way?) would want to suppress photos of this statue which have already been published by the National Park Service. The purpose of the statue is to enhance the legacy of Dr. Martin Luther King, Jr., by erecting a highly visible outdoor monument in a place frequented by tourists. Nobody is going to suffer any revenue loss if this picture appears in a Wikipedia article, and such an article without any picture makes no sense at all. To understand the monument, the Wikipedia reader needs to know what it looks like. HowardMorland (talk) 13:55, 22 June 2012 (UTC)

- Keep This takes FOP-enforcement much too far. This is a national monument for an assassinated hero, for heaven's sake, and no court anywhere in the United States is going to sustain a lawsuit based on publication of these images. We must have some common sense about this. Beyond My Ken (talk) 19:11, 1 May 2015 (UTC)
- That line of reasoning is explicitly prohibited by Precautionary Principle #1. Also, it's wrong. The King heirs have been aggressive about the copyright for his writings and speeches -- the builders of this monument had to get licenses. - Yes, entirely the wrong way. Although nothing will probably come of it, I've asked at WMF Legal for someone to come here and explain that the generally overzealous enforcement of FOA for national monuments is unnecessary. Beyond My Ken (talk) 21:40, 1 May 2015 (UTC)

- Gaylord's contractual position was the same as most of the monuments and memorials that we have researched -- the creator almost always retains copyright. And note, by the way, that even if the contract transferred copyright to the government, it is still not PD, because Gaylord was not a government employee. The government owns and enforces copyrights on works created for it by others -- the Sacagawea dollar is a prime example. Unless you can prove that the MLK National Memorial contract explicitly transferred copyright to the Federal government and that the Federal government has chosen to put it into the public domain, we can't keep these images. And, as I noted above, the King heirs required that his quotes be licensed specifically for this purpose -- it would be extremely surprising to find that they had allowed those copyrights to become PD. . Jim . . . . (Jameslwoodward) (talk to me) 20:12, 2 May 2015 (UTC)
- I'm sorry, you're contradicting what was said on the Meta page about the Gaylord decision, that an unusual situation prevailed. Gaylord is not generally applicable, especially since it was the decision of a single circuit and have never been reviewed by the Supreme Court.Template:ParabrThe notion that I cannot walk under Federally-owned land -- which means owned in some portion by me -- and take a picture of a Federally-funded monumnet of a national hero without getting the permission of an artist paid by the government *my government} to do the work, is perverse in the extreme, but what's more perverse, is that Commons bends over backwards to interpret the law in the most restrictive way possible, meaning that, potentially, this supposedly useful repository of images won't have a picture of the King Memorial in it for perhaps 100 years, depending on how long the sculptor lives.Template:ParabrSuch idiocies are what make this place so damn frustrating, as there doesn't seem to be a lick of common sense around the place. You, as an admin, are not required to use your powers to do anything at anytime, and yet you choose to use them to make the repository a distinctly less useful place, denying to our users images they can (and will) get from other places that aren't so frigging literal about everything.Template:ParabrThere's the law, and then there's what's right, and what you're doing is just not right - you don't have to do it, and yet you do. That just sucks.Template:ParabrI'm unwatching this page, as I'm sure the images will be deleted by another admin lacking in imagination and concern for how we service our readers, and I can't bear to see yet another memorial deliberately disappeared from the Commons because of overzealous enforcement of FOP. You're ranting in the wrong direction. Complain, instead, to MLK's heirs, who aggressively defend the copyrights on his works, to the people overseeing this project who didn't bother to acquire the copyright to the sculpture from the creator, to the government, which rarely releases the copyrights it owns (witness the copyright for the Sacagwea dollar), and Congress, for not enacting broad FOP. . - Keep the images which don't show King's words, if that's the perceived problem. Have the King family lawyers contacted Wikipedia about any of these? If not, why the need to delete, and just move them to Wikipedia if that's a concern (I don't know why Wikipedia trusts Commons with images which, instead of being deleted, can be moved to the Wikipedia collection). [edit]This user has had numerous individual DR's of low-res images that all look like screengrabs. It is better to make one DR of all these uploads so that they can be considered together. Because taken together, we see a pattern of images with disparate sizes, quality, and styles, inconsistent or missing EXIF data. These can't be own works. To settle these ongoing DR's once and for all, the uploader is asked to provide proof (e.g. upload some of these images in high-resolution c/w EXIF data).

Russia does not have Freedom of Panorama for sculptures or monuments...such as this modern war monument. It only has FOP for modern buildings, bridges and dams. Leoboudv (talk) 02:55, 18 November 2014 (UTC)
Delete Valid FOP objection, the photo title on Flickr indicates this is a '100th anniversary' monument, so obviously of very recent construction even without knowing the exact location. Also, the name of the photographer in the EXIF is not the same as that of the Flickr uploader, which makes it seem likely that person is only the author of the collage, not the original images, and thus the licencing is dubious. - The source of Vizcarra's photo states. "Peruvian presidential press photo by Andres Valle via AP". That means it wasn't the work of AP, but distributed by them. If the Peruvian presidency releases those files under a free license there is no problem for them to be hosted here. This other source says it is the work of JUAN PABLO AZABACHE/AFP/GETTY IMAGES. Then this one credits it to "Andres Valle/oficina de prensa de la presidencia de Perú, via AP". Such statement is repeated by AP itself [12].

These two images of the same letter are out of COM:SCOPE. An uploader's plea to Wikimedia Commons users and administrators cannot change freedom of panorama status or outlook. Furthermore, with the proposed freedom of panorama provision now pending in Congress as of today, the utility of the content of these letters is diminished.

Strong keep: ref. 1, ref. 2, ref. 3, ref. 4, ref. 5, ref. 6, ref. 7 In December 2018, "Azerbaijan Pomegranate" badge was established by the Association with the consent of the Office of the President of the Republic of Azerbaijan. The main purpose of the establishment of this badge is to reward the persons who have contributed and served in the development of pomegranate growing, Association activity in the Azerbaijan Republic.
History "Azerbaijan Pomegranate" badge was established by the order of the chairman of the Association of pomegranate producers and exporters of Azerbaijan No. 01/2018, dated 3 September 2018 to reward the persons who contributed to the development of pomegranate growing. Patent and Trademark Expert Center of Intellectual Property Agency of the Azerbaijan Republic accepted the badge for examination on 31 January 2019.
Aims and objectives The main purpose of the creation of this badge is to maintain the economic, cultural and social importance of the pomegranate by awarding the people who contribute and pay attention to the Azerbaijani pomegranate and services and work in the activities of the Association of Pomegranate Producers and Exporters (PPEAA).
Establishment of the "Pomegranate Narcissus" is fully compliant with the Charter of ANIA and serves the following tasks:
- to support and promote measures undertaken by state and non-state bodies in the area of economic and social development;
- to help increase productivity in poultry farms;
- rewarding individuals engaged in awareness-raising and promotion activities on pomegranates;
- According to the "Azerbaijan Pomegranate" badge civil servants, businessmen, social activists, journalists, scientists, and cultural figures who are involved in pomegranate development can be awarded this badge.
Production In connection with the production of badges, PPEAA applied to the Office of the President of Azerbaijan Republic by letter dated 2 September 09-2, 018, dated 5 September 2018. With the approval of the department, Azersuvenir LLC manufactured the «Azerbaijan Pomegranate» badge in November 2018.
Description The industrial pattern of the "Azerbaijan Pomegranate" badge is characterized by a plate for fastening clothes, a connecting element, a hanging element with artistic and decorative components on its surface. The perforated plate of the badge is fastened with a hanging element and a connecting ring. On the opposite side of the sink, there is a fixing element.
In the center of the badge, there is a multi-pointed star in the form of detachable Rays, in which the framed circular element is located. The signboard of the badge is made of oblong rectangles with an elongated horizon. The lower part of the board is decorated with a plant ornament. The two branches are performed in such a way that they are combined with a transverse plaque, decorated with symmetrical eyebrows. The middle of the lavatory is covered with enamel of red color. Stylized varnishes, consistently placed on both sides of the lavatory, are covered with a mine of green color.
The multi-beam star is made of metal of yellow color. The edges of the star are worked out in the form of sharp angled Tilly elements. The central element, which is circular, is framed in the form of a stylized pomegranate with gold-colored metal in the form of a bell. In the center of the badge with a red background there is a picture element of red, blue and green in the form of three leaves and a stylized inscription "PPEAA". On the opposite side of the hanging element is written the words Association of Azerbaijani pomegranate producers and exporters. Each badge is individually numbered by "Azersuvenir" LLC starting with the number ”001".
The diameter of the tab is 40 mm, 8-pointed star, colors of the Azerbaijani flag on pomegranate mines, 3 ruby stones, pomegranate figures, the green leaves of the pomegranate tree, the spike and the logo of the Azerbaijani Pomegranate Producers and Exporters Association are engraved on the sign with gold. --Elshad Iman (Elşad İman) (talk) 19:09, 26 May 2021 (UTC)
Deleted: per nomination - All of the above is interesting, but not relevant. It is a medal awarded by a private association and is therefore copyrighted. The copyright may be held by the creator of the design or by the association, but in either case we need a free license from the one who owns the copyright. . Jim . . . This file was initially tagged by Guarapiranga as Copyvio (copyvio). It is not. See the license tag I put on it: Template:PD-chart. It applies. This is a basic statistical chart. See: Commons:Threshold of originality#Charts. Timeshifter (talk) 23:01, 11 May 2021 (UTC)
- Commons:Threshold of originality#Charts lists four charts that have been deemed ineligible for copyright protection, none of which is this one. It doesn't state any policy that would apply to it. Guarapiranga (talk) 00:11, 12 May 2021 (UTC)
- Commons:Threshold of originality#Charts. Look at the first chart. It is a bar chart. Also, look at Category:PD chart. Also, look at my evolution on the issue. I used to think all charts were copyrighted. I was wrong. Not the first time I have been wrong. :)

- Also, look at my evolution
- I'm sorry, your evolution is not policy. -- Guarapiranga (talk) 09:23, 12 May 2021 (UTC)
- Who said it was? Policy is policy. It is separate from my evolution or yours. --Timeshifter (talk) 12:21, 12 May 2021 (UTC)
Kept: no valid reason for deletion -- There is no copyright here -- this was almost certainly created by Excel or other automatic software. [edit]Metadata indicates these as sourced from "www.gobautista.net". While the website may be operated by the uploader himself, it is no longer accessible today, and it is unsure if his website is licensed under CC-BY, CC-BY-SA, or PD licensing (some rights reserved or no rights reserved). If his website was licensed under "all rights reserved", then it is unfree (meaning these cannot be reused commercially, thus incompatible with COM:Licensing).

- Keep. If the whole document is in the public domain in the US, the creator of any derivative work made from that document, such as these images, may also disclaim any rights they have (which in this case is pretty much none, as it is simple retouching and image processing), and dedicate that derivative work to the public domain. -- The Anome (talk) 15:33, 14 May 2021 (UTC)
- I understand, but in this case, something else is being discussed here. The photo may be protected by copyright by default (for example, the copyright could belong to the photographer or the CPSU). Only the entire stamps/documents are in the public domain, and not any cut-out objects located on them. Roman Kubanskiy (talk) 08:30, 20 June 2021 (UTC)
