Per the URAA they have retroactively become copyrighted in the US and are therefore non-free for the purposes of Commons even though they are now PD in Germany and Brazil. There are several rights to consider here:

  • Copyright on translations: Normally belongs to the translator
  • Performance rights: Normally belongs to the performers (in this case the singers and the orchestra members)
  • Sound recording right: Belongs to the one operating the sound recording device

It says that the uploader was the "general director of this Arirang project in 2013", but we can't assume that this automatically makes him the holder of all of the rights associated with the file.

Dies widerspricht jedoch den Lizenzbedingungen der Lizenz CC BY 3.0, unter denen die Bilder in die Wikimedia Commons eingestellt wurden. Die Lizenz sieht zwar vor, die Urheberschaft ausreichend deutlich zu benennen, jedoch nicht, dass dies direkt auf der Seite geschieht, in der die Bilder eingebunden wurden. Die Wikipedia verwendet die Bilder der Wikimedia Commons ohne direkte Namennennung auf der Seite und muss mit einer eventuellen Abmahnung des Autoren rechnen, wie im nachfolgenden bei Nutzung eines Bildes außerhalb der Wikimedia Commons geschehen. Wieviele seiner Bilder tatsächlich in der Wikipedia verwendet und vom wem sie eingestellt wurden, ist mir nicht bekannt.

Um seiner Rechtauffassung zur Verwendung der Bilder Ausdruck zu verleihen, verschickt Benutzer:Pixeldost Abmahnungen und verlangt für die, seiner Meinung nach, unsachgemäße Nutzung Schadenersatz. Um dies zu verdeutlichen sei kurz folgender Fall geschildert:

Für die Verwendung des Bildes von Waldemar Hartmann, das Benutzer:Pixeldost als Michael Lucan unter CC BY 3.0 in die Wíkimedia Commons eingestellt hat, verlangte er eine strafbewehrte Unterlassungserklärung und Schadenersatz, weil dazu angeblich keine Berechtigung vorlag, weil der Name des Autors nicht genannt wurde. Für die Nutzung (2 Monate) errechnete und verlangte Benutzer:Pixeldost 105 Euro und einen 100%-igen Zuschlag wegen unterlassener Autorenangabe, also gesamt 210 Euro, den er jedoch großzügig aus pragmatischen Gründen auf 175 Euro senkte. Ob der Schadenersatz und die Höhe der Schadenersatzforderung so in Ordnung ist ???

Das Bild befand sich seit Ende November 2013 auf der Website, die Rechnung kam Ende Januar. Das Bild hat er nach eigenen Angaben über die Google-Suche gefunden, es war sogar ein Zeugen beim Auffinden des Bildes anwesend (so schreibt er). Wer allerdings in der Google-Bilder- oder Websuche nach 'Waldemar Hartmann' sucht, findet das genannte Bild für die doch eher winzige Website in Google schwerlich (nach Seite 50 immer noch kein Waldemar). Möglicherweise stehen ihm ja andere Möglichkeiten zur Verfügung? Spielt ja auch keine Rolle. Wohl aber der Verdacht, dass er das Web systematisch nach seinen Bildern absucht, auf "unrechtmäßige" Nutzung prüft, um dann Abmahnungen zu veschicken und Schadenersatz zu fordern. Als Urheber kann er natürlich prüfen, wo und wie seine Fotos verwendet werden. Nur stellen sich im Hinblick auf die Bilder, die er in die Wikimedia Commons eingestellt hat, folgende Fragen:

  • Wäre es im geschilderten Fall nicht ausreichend und im Sinn der CC BY 3.0, zunächst auf die Nicht-Namennennung hinzuweisen und diese einzufordern?
  • Muss bzw. darf Diskussion:Mlucan bei einer CC BY 3.0-Lizenz gleich die Keule rausholen und eine strafbewehrte Unterlassungserklärung und Schadenersatz forden?
  • Diskussion:Mlucan, der offensichtlich gewerbliche Foto- und Web-Dienstleistungen anbietet, bedient sich des freien Medienarchivs Wikimedia Commons als Datenspeicher und Werbeplattform für seine Bilder. Immerhin hat er zurzeit 225 Bilder online gestellt. Sollten gewerbliche Nutzer nicht für diese Dienstleistung der Gemeinschaft zur Kasse gebeten werden?
  • Sollten Lizenzen, die mögliche Urheberrechtsverletzungen? mit anschließenden mehr oder minder hohen Schadensersatzforderungen nach sich ziehen, überhaupt in der Wikimedia verwendet werden? Heißt, sollte nicht die einzige in der Wiki verwendete Lizenz die CC0 (public domain) sein?

Um nicht falsch verstanden zu werden, möchte ich anmerken, dass jeder Urheber natürlich das Recht hat, seine Urheberrechte wahrzunehmen und im berechtigten Fall auch Schadenersatz zu fordern. Aber: Gehören Urheber, die die freie Enzyklopädie Wikipedia bzw. das freie Medienarchiv Wikimedia nutzen, und ihre, ihnen natürlich zustehenden, Urheberrechte in genannter Weise durchsetzen, tatsächlich dort hinein?

Der Schriftverkehr zu geschildertem Fall kann gerne zur Verfügung gestellt werden.

Hallo Bolzerei,
die Bilder sind dem Anschein nach unter einer in für Wikimedia Commons sachgemäßen Art und Weise lizensiert, hier wohl als cc-by-sa-3.0. Trotz weitergehender Anmerkungen unterhalb des Lizenzblocks (die ich jetzt gar nicht rechtlich beurteilen möchte und weder loben noch kritisieren möchte), weist er ja ausdrücklich darauf hin, dass "Rechtsgültig ... allein der Lizenzvertrag in seinem Wortlaut [ist]". Ich kann daher nicht erkennen, dass die von ihm gewählte Lizensierung (auch in Verbindung mit den gemachten Zusätzen) einen Löschung begründen könnte. Wenn darüberhinaus bei der Weiternutzung der Bilder rechtliche Probleme aufgetreten sind, dann ist das keine Angelegenheit, die Wikimedia Commons betrifft.
Der Bildautor hat das Recht auf Einhaltung der Lizenzbedingungen. Ich möchte und kann nicht beurteilen ob die Nutzung hier nach diesen Bestimmungen stattgefunden hat oder ob das Urheberrecht verletzt wurde - zur Klärung dieser Frage existieren unsere Organe der Rechtspflege. Selbstverständlich kann der Autor aber seine Urheberrechte in der ihm geeignet scheinenden Weise verteidigen. Es bleibt ihm (und evtl. seinem Anwalt) überlassen, welchen Weg er dazu wählt. Ich kann und will auch das nicht bewerten. Du, Bolzerei, kannst dich dagegen ja (juristisch) wehren. Ein Tipp (das ist jetzt keine Rechtsberatung): Wenn du dich dagegen juristisch wehren willst, halte ich es für eher unklug, dass du dich hier weiter den Fall auslässt. Wenn man in der selbst geschaufelten Grube sitzt und wieder hinaus will, sollte man zunächst mal das Graben einstellen. Eine Anlaufstelle zur rechtlichen Beurteilung (nicht zur rechtlichen Beratung) kann w:de:Urheberrechtsfragen sein.

PS2: Eine Bildersuch nach bestimmten Bildern, die auf Wiki Commons rumliegen, geht ganz einfach mit der Google Bildersuche, wie hier beschrieben: https://support.google.com/websearch/answer/1325808?hl=de . Einfach Im Fall des Bildes von Waldi z.B.: diese Suchanfrage, die ja gleich etliche Verwendungen ausspuckt. es ist nicht zutreffend, das ich - meine drei Usernamen sind offen kommuniziert - irgendwelche individuellen Einschränkungen bezgl. der von mir vergebenen Lizenzen mache oder Ergänzungen vornehme. Ich habe ein paar Erläuterungen angegeben und ansonsten verlasse ich mich auf den Lizenztext. Ich "verlange" nicht einmal, dass mein "Name direkt auf der Seite genannt wird, auf der die Bilder eingebunden sind"), ich erwarte lediglich, dass die Angaben wie von der Lizenz vorgegeben überhaupt gemacht werden und - selbstverständlich - dass klar ist, welches Bild gemeint ist.
Richtig ist, dass ich großzügig bei der Auslegung der Lizenzen bin und auch nicht ganz lizenzkonforme Nutzungen anerkenne und nicht abmahne, höchstens einmal eine Nachbesserung anrege.
Bolzerei hat ein Bild von mir bearbeitet (oder jedenfalls eine nicht als solche gekennzeichnete Bearbeitung verwendet) und ohne jeglichen Hinweis auf der eigenen Webseite veröffentlicht. Das Bild wurde nicht zu einem redaktionellen Zweck sondern nur zur Aufwertung der eigenen Webseite (die über und über geschütztes Material - nicht von Wikimedia Commons sondern aus anderen Quellen verwendet) benutzt. Auf meine Abmahnug hin wurde mir eine angeblich vorhandene Kennzeichnung präsentiert. Ich konnte (und kann) beweisen, dass diese erst nach meiner Abmahnung angebracht wurde. Dies ergibt sich auch aus dem Google-Webcache in der die betreffende Seite OHNE den Hinweis gespeichert ist und aus meinen vor der Abmahnung angefertigten Screenshots (was auch ein an dem Tag anwesender Besucher bestätigen kann).
Die Behauptung, die Kennzeichnung sei dagewesen, hat Bolzerei dann - angeblich nach Beratung durch einen Rechtsanwalt - implizit zurückgenommen, jedenfalls den angekündigten Brief dazu dann doch nicht geschickt. Sondern eine - leider laienhaft formulierte - abwegige Unterlassungserklärung.
Um es kurz zu sagen: Bolzerei hat entweder die Lizenzbedingungen gekannt und bei seiner Nutzung bewusst dagegen verstoßen, Möglichkeit 1. Oderː er hat die Lizenzbedingungen nicht gekannt, Möglichkeit 2. Es ist nicht einmal sicher, dass Bolzerei das Bild von Wikimedia Commons bezogen hat. Woher das Bild bezogen wurde, hat Bolzerei bis heute mir gegenüber nicht erklärt.
Mir erscheint (ǃ) es so: In dieser Sache hat Bolzerei - eine Finanzdienstleistungs-GbR, bestehend aus 2 Personen -, nach meiner berechtigten und notwendigen Abmahnung nachträglich recherchiert und das Bild auch bei Wikimedia Commons gefunden. Auftrumpfend hält er mir dann vor, hier unberechtigt vorzugehen und behautet, die Bedinungen eingehalten zu haben.
Eine freundliche Entschuldigung mit einer nachvollziehbaren Erläuterung der Umstände der Nutzung hätte mich versöhnlich stimmen können; aus meiner Sicht wäre dann (und NUR dann) vielleicht (je nach dem, was ich da zu hören bekomme) eine Einigung deutlich unterhalb meines - in meinen Augen für einen gewerblichen Nutzer moderaten (!) - Vorschlages möglich gewesen. (Natürlichː die richtigen Abmahner warten, bis 1/2 Jahr voll ist und beauftragen dann einen Anwalt, soll der sich die Finger 'schmutzig' machen - Hätte ich etwa so verfahren sollen, damit ich richtig Kohle mache? Nein, so bin ich nicht drauf.)
Alles abzustreiten und sehr grenzwertig zu reagieren (was ich davon halte, nachträglich mit falschen Behauptungen abgespeist zu werden, fasse ich lieber nicht in konkrete Worte) hilft hier nicht weiter. Auch das Impressum mit Übergriff auf meinen (nicht als meinen gekennzeichneten) Inhalt ist in dieser Hinsicht mindestens missverständlich (oder schlecht abgeschrieben), für eine Finanzdienstleistungs-GbR und somit gewerblich Tätige ebenfalls wieder: grenzwertig.
Und tatsächlich: Ich nutze Google, um für VG Bildkunst Verwendungen meiner Bilder (diejenigen, die mir nicht gemeldet werden) zusammenzustellen. Was ist daran falsch?
Und abseits dessen: Ich bitte einmal dies zu bedenken: Wer immer lizenzierte Bilder verwendet, ohne sich an die Bedingungen zu halten, eröffnet eine Gefahr: Das Bild kann von irgend jemand anderem hergenommen und (womöglich noch mit falscher (C)-Angabe zB in dieser Sache "Bolzerei") weiter verbreitet werden. Sowas passiert und ich kann es - für andere Seiten - belegen. Das ist sehr, sehr unerfreulich, und so etwas zu verhindern ist einer der vielen Gründe, warum ich Nutzungen ohne jeden Hinweis auf die Lizenz und auf mich, wie durch Bolzerei, n i c h t durchgehen lasse. Ich will nicht, das durch solche Geiz-ist-geil-Typen oder Leute mit der Einstellung "ICH ICH ICH", also Typen, die nur nehmen und nicht mal bereit sind, die einfachen Lizenzbedingungen einzuhalten, andere in eine Falle laufen und denken: "Oh: Schönes Bild von Waldemar Hartmann. Das nehme ich mir. Ist ja frei für nichtkommerzielle Nutzung (lt. Impr der Seite von Bolzerei), schreibe ich halt '(C) Bolzerei' hin, da freut sich Bolzerei". Ich will nicht auch noch solche Nutzungen zu Hauf erleben müssen. Nein.
an Bolzerei: Komm zu Dir. Sieh Deinen Fehler ein. Und sieh' bitte auch ein, dass Du nicht gerade adäquat reagiert hast. Mach es nicht noch schlimmer.
Ich sehe keinen Grund, warum dieses Bild - http://commons.wikimedia.org/wiki/File:Karlheinzboehm2008.jpg - gelöscht werden solte. Selbst Bolzerei kann dieses Bild gerne (unter Einhaltung der Lizenzbedingungen) nutzen. Nur das Waldemar-Hartmann-Bild nicht mehrː s. CC-BY 3.0 Absatz 1 Buchstb. g mit Absatz 7 a (Für diejenigen, die's formell korrekt wünschen).

Hallo zusammen! - Ich sehe keinen Grund die Bilder vom Server zu nehmen.
Habe mir einige Bilder und die dazugehörige Lizenz angesehen. Ich sehe da keinen "Verstoß" gegen eine Lizenzierung wie sie auf Commons üblich ist. Der user weist in der letzten Zeit sehr deutlich auf die Lizenzbedingungen hin, hält sie aber genau ein. Damit ist der Commons-Konform (oder sehe ich das als "Rechts-Laie" zu einfach?). Auch der Vorwurf des Missbrauchs der Commons als Bilderspeicher und Werbeträger sehe ich nicht. Der Bot hat angefangen zu entlinken, weil die Bilder bereits gelöscht wurden (also keine Bot-Fehlfunktion). Ich habe den löschenden Admin Fastily daraufhin auf seiner Disk angesprochen und er hat die Bilder wiederhergestellt. Auch ich sehe keinen Grund für eine Löschung. Wenn wie im hier beschriebenen Fall nicht einmal der Versuch gemacht wird, die wirklich mehr als deutlich zu sehenden Lizenzbedingungen zu erfüllen, braucht sich über die Konsequenzen imho nicht zu beschweren. Ich habe die Löschanträge beendet. Der Antrag ist hahnebüchen. Die cc-by-sa-3.0 erlaubt eindeutig die kostenfreie Nutzung unter der Bedingung der Autoren- und Lizenznennung am Bild. Wer das nicht tut hat Pech, der muß damit leben, wenn er dann zahlen muß. Einen Löschgrund gibt es nicht. Zudem verwarne ich Bolzerei für diesen Löschantrag, der durch nichts gerechtfertig ist, eindeutig persönlich motiviert ist und mir viel Zeit meines Lebens beim abarbeiten gekostet hat, die ich nie wieder bekomme. Ein weiterer solcher Antrag nur weil ein Fotograf es wagt auf die Einhaltung der Lizenzen zu pochen geht gar nicht. I apologize if I originally inserted this case into the incorrect process. My rationale was that COM:CSD#F5 states "The file is missing essential information ...", which seemed to be a true statement, and the template (despite its name "No license") does appear to cover the more nuanced case "This media file does not have sufficient information on its copyright status." But – this file has been around for some time, so I don't really mind whether we handle it as a speedy or a deletion discussion. Whatever works best to obtain a fair and correct result. The picture is not really educationally useful and in Germany (and some other countries) forbidden (§86a StGB, Verwenden von Kennzeichen verfassungswidriger Organisationen (using of insignias of anticonstitutional organisations), as it shows a nazi swastika. I've found out the date of publishing this image. It is 1939! Firstly I've indicated the period when monument has been existed. Now we can be sure, that the age of the image is over 70 years.
What is relevant here is the date of death of the photograph (Е. А. Probably not. Mime Misu was born Misu Rosescu on January 21, 1888 in Botosani, Romania.[2] That's all the information the IMDB has on him. But there is this article on him that quotes 1921 articles[3]in English via Google Translate that talks about Mr. Misu and the Misugraph Film Company. One Romanian book calls him Mişu Rosescu, which may be a careless respelling or a more accurate version of his original name. I'm afraid, this is not sufficient to assume the move is PD. As this is a German movie, it needs to be PD in Germany. German copyright law requires, that _all_ people creating this movie must have been dead for at least 70 years. This includes camera men etc.. I don't have a complete list of people working on this movie, but unless we know for sure that they are all dead, we cannot assume, that the movie is PD in Germany. Photographs are usually PD-US but since the Titanic never reached the USA it is unlikely that the country of origin for these is the US. These were all taken in either the UK or France and would therefore need to qualify for PD-old. They were all obviously taken between 1911 (ship launching) and 1912 (sinking) so they are all about 100 years old. For them to be PD-old that means that all photographers must have died before 1944, i.e. the could not have lived for more than 32 years after taking the picture. Images of the Titanic itself must, as ChrisiPK notes, have been taken in the UK and are too recent to assume they are out of copyright there. I assumed that most of the images of Capt. Rostron were taken in the UK, save one with his crew with a cup in the foreground. Artist's drawings might be from US or UK sources, so precautionary principle requires deletion. I can't prove anything, but I find it doubtful the FlickR source had authority to release this image. If you look at the source FlickR account, you'll find a total of 7 photos released on CC (and just one other photo). Nowhere in the descriptions does the FlickR account assert ownership or they were the photog. Two photos are screen grabs from Star Wars[5], which were also uploaded by the same Commons User and deleted. The image of Molyneux is low resolution, and looks like it could be a screen grab, or just a random image taken off the web, and not something straight from the camera, as is more typical. Hello. I in fact do possess the right to release this image. To suggest otherwise would imply that Stefan Molyneux, the person from whose video I extracted the image, would desire me not to do so. Stefan Molyneux is a vocal opponent of intellectual property and thus has released all of his written, video and audio material free of copyrighting or patents. He has stated repeatedly that he has no compunctions with any of his work being used by people elsewhere (in fact he encourages it), and he does not ask that people seek permission from him to do it. As I said, he is a vocal opponent of intellectual property. He places no proprietary claim on any digital material he releases. Thus your concern is unnecessary. Watch this video if you wish to see him discuss intellectual property. These look like Flickrwashing. The Flickr account was created in June and the pictures were uploaded to Flickr on either the same day as they were uploaded to Commons, or on the day before. Also, at least two of them look like magazine scans.

It's very unlikely that the Flickr-user, from whose page this has been taken, is really the photographer, especially as he claims to have it shot in 2013. Quite. Contrary to the U.S., Germany has no PD-Gov. Photos from the WWII era are generally considered to be likely still copyrighted, if no evidence to the contrary is available. Though the duration of copyright protection at that time was only 50 pma, it got prolonged to today's 70 pma for all works which weren't PD already in 1965. The depicted ship en:German destroyer Z2 Georg Thiele has be commissioned in 1937 and sunk in 1940. This file appears to have been taken from a copyrighted source (on the web since 2001). If it's PD for some reason, I don't know why. As it has over 100 transclusions, it would be nice if there was a reason! Rd232 (talk) 00:29, 18 December 2012 (UTC)[reply]

In the terms of FOTW, the images are made by the contributors to the website and the mailing list (and if they are not made by the members, we credit the source). The FOTW copyright restricts modifications and commercial reuse. With this image, it was made in 2001 by a contributor (his contact info is at this site). The flag was adopted in 2001, but the symbols were from the 1970's. It was just uploaded with {{PD}} and never was really decided upon. I am also trying to check out the copyright terms of Italy and this is a reproduction of what could be legislation, but with elements added by the author. I will say  Delete. This is a semi-generic structure that doesn't have an obvious use-case. "Ortho- bromobenzene" is not a standard substituent or core. It was probably originally created for de:Ipso-Substitution (based on filename) but was not actually used there (and that article seems well-illustrated by alternatives). These three images are credited "Arthur Edwards/ The Sun", so are probably not covered by the OGL or the OTRS permission for Foreign and Commonwealth Office images.

No. This is the only image available as of date in the internet on this context. It's a ritual in some of the Indian states to have the saplings of plants in a bucket and praying it. So, kindly retain the file. I will try to upload one new. But, months need to take the picture. Also, you can google the name, and there are very few files of it in the internet. So, for at least that purpose, you can retain it. I would accept if there was no file (See my talk page, I have accepted to delete many low-res files I have uploaded in the past). Please retain it.
