- Keep I use an SLR which is capable of burst photography. If more than one of the photos I take on a particular subject turn out to be fine, quality shots, I upload them all. Last I checked, there is no rule that prohibits me from providing such photos to reusers (whom I frequently receive thank you emails from!) and wmf wiki editors. Previously part of a mass deletion nomination which was withdrawn by the nominator (Commons:Deletion requests/PD-AR-Photo de la Guerra de Malvinas). So here I am nominating an individual image. This was first published in Argentina in 1987, so it was still copyrighted on the URAA restoration date. This will be copyrighted in the US until at least 1/1/2053 (if the photographer -- not identified here, but possibly listed in the original publication -- died in 1982) and possibly far longer. It's PD in Argentina, and so I think it can be copied to Wikilivres since Canada uses the rule of the shorter term. cmadler (talk) 14:08, 16 July 2012 (UTC)

It appears that this was still under copyright in Canada on the URAA restoration date, therefore it has a US copyright until at least 1/1/2044 (this assumes publication in 1948, the year of creation, and US copyright of 95 years from publication), and possibly as long as until 1/1/2077 (70 years pma). I think it's most likely that this was published shortly after creation, and so copyright expiration of 1/1/2044 or 1/1/2045 seems most likely. The above reasons for deletion request seem to be a fabrication of reasons without evidence against donations and contributions to Wikimedia Commons. [edit]The Peace Statue in the Nagasaki Peace Park seems to have been unveiled in 1955 with the opening of the park. The statue is by Seibo Kitamura, who died in 1987. Japanese copyright duration is 50 years pma, therefore the statue is under Japanese copyright until 1/1/2038. Because it was copyrighted in the source country on the URAA restoration date of 1/1/1996, the US copyright of 70 years pma will expire 1/1/2058.

Unfortunately, the user does not have access to the photographs or author information so we are not aware which ones are copyright free as derivative works. See this discussion on AN for detailed info. The OTRS tags on some of them are also likely not valid as they don't have artists name or any information on the source images. Five of the images have already been nominated for individual DRs, so bringing the rest up together here per the discussion at AN. Also, as for the source images, per this link found by User:Asclepias they were all web submissions of jpegs, so the provenance was never considered.

Comment This is in the UK and the subject is not a graphic work. Normally this would covered by the UK's Freedom of Panorama rules, but the description shows this sign to be present at an "event" so it's display would seem to be temporary. I'm not at all sure that the sign makes it as a sculpture or work of artistic craftsmanship (as opposed to simple craftsmanship): British courts are less keen than US courts, to uphold copyright on objects (eg. Star Wars costumes) that aren't clearly art works. Does anybody have any precedents that might apply? - Schoenberg was living in the US when he wrote this, and it was premiered in 1948 at the University of New Mexico. It's reasonable to guess that it was probably first published in the US. Was it published with a copyright notice, and was copyright renewed? cmadler (talk) 13:47, 16 July 2012 (UTC)
- Nominator's reason for deletion appears not valid; the works would presumably be under US copyright law, and status US works from this era are not affect by date of death of author. However some actual info on status of copyright of the work should be added. May still be under US copyright if copyright notice was filed and renewed. - There is no permission from the photographers. See COM:ART#Photograph of an old sculpture found on the Internet, or in a book.
- German coins do not appear to be free in Germany. See COM:VPC#German currency and Commons:WikiProject Public Domain/German stamps review. People sometimes seem to claim that coins are free because of § 5 Abs. 1 UrhG, but it seems that § 5 Abs. 1 UrhG only applies to text and these coins are images.

- Speedy delete. All the files listed above are just recent reuploads, by one user, of previously deleted files. Their deletion is already decided.
- About your first point (no permission for the particular photos or illustrations), please see Commons:Deletion requests/Template:Eurocoins. The uploader has again reuploaded photos/illustrations from this same website, which images are considered not free for Commons, per that DR. Unfortunately, from time to time, some people attempt to reupload images from this website. There is no need to go through a new DR everytime. But there is a need to speedy delete those files when they are reuploaded.
- The first point is already enough to speedy delete all the files listed above, so we could stop here and it would not be really necessary to examine your second point (about the status of the German coin designs), but anyway, the argument about the possibility of applying § 5 (1) to coin designs was an attempt by some people to stretch the München case of 1987, which was about stamps. And as that § 5 (1) argument doesn't hold anymore even for stamps, after having been rejected by the Berlin case of 2012, it is difficult to imagine how the stretch could hold for coins. Besides, IMO, the reasoning on which the § 5 (1) argument was based did not contain anything that would have allowed to consider that the artists' works would have become retroactively free in the United States.

- Comment: The question is how much evidence we need and now much "good faith" we asume.
- According to en:Fiat CR.32 "The Fiat CR.32 was an Italian biplane fighter used in the Spanish Civil War and World War II." and the information box says it was produced "c March 1934 - February 1936". That makes it likely that it the photo was from back then and that it is from Italy.
- It is probably an edited version of http://www.finn.it/regia/immagini/fiat/cr32_x_gr_baleari.jpg and google indicates that this is indeed an original photo and not a computer drawing or other recent creation. The text above the photo on http://anthrocivitas.net/forum/showthread.php?t=4856 says "A pair of Fiat C.R.32 of the X Gruppo "Baleari". The foreground aircraft is flown by D'Agostini." I do not speak Italian but it:Aviazione Legionaria seems to suggest that "Baleari" was active in 1937 and 1938. That should prove that it is not just a surviving fighter that was in a recent "aircraft show".
- All in all: I can't prove where and when it was first published. But I see no reason to asume it is a computer drawing or other recent creation. --MGA73 (talk) 20:00, 16 July 2012 (UTC)
- Comment - we can almost certainly know the image was created in Italy prior to 1940, and thus is free there. However, we do not know the publication history of the image, and as such its free status in the US. This is a problem we have with 99% of images on Commons currently marked PD-Italy. I created a chart for its status in the US at Template:PD-Italy/US. However, even that may be incomplete, depending on the status of any mutual copyright agreements between the US and Italy, which did exist according to w:Wikipedia:Non-U.S. copyrights#Subsisting copyrights (someone once showed me on COM:VPC how to look up presidential proclamations for individual countries, but I can't remember how, and I'm having computer issues so I can't look it up). It was actually given by Tenafly Police Department, however the copyright licence couldn't obtained as he agreed only for Wikipedia for acknowedgement of TPD. https://developer.android.com/license.html reads "Google's trademarks and other brand features (including the Android stylized typeface logo) are not included in the license. - I am answering about the derivative image I uploaded related to this one: Plaatje (right) died in 1932, eighty years ago. He also looks much, much younger than the others... - Keep Currently I see no reason for deletion. Just saying "there is no exception for copyright on Austrian currency at all" does not make it true and no arguments have been provided for us to judge whether that's correct or not. Now, I'm not an expert in Austrian law, but if it is similar to German law (which is mostly the case), there is good reason to assume that currency is covered by § 7 UrhG. At least it's not as clear as the nominator claims it to be and we need an expert of Austrian copyright law to answer that question fully; for example: the "Praxiskommentar zum Urheberrecht" which I found on GBooks says that currency is a grey area ("Grauzone") (cf. § 7 marginal number 4 of the book I just mentioned). The notion that banknotes (and also stamps) are free in Germany is based on a highly controversial court case a while ago that ruled that stamps are in the public domain due to being published in an official paper.
