Andy Wolfe is a Flight test photographer employed by Lockheed Martin.[1] He is not and was never a US federal employee. The US Navy and Air Force are only licensing his photographs for their use. - LinkedIn is a social networking website and provides no reliable evidence of the credited (or any) Andy Wolfe's employment now or previously where it's relevant to this discussion. For that matter, United States federal employment is not the only process for an individual's works to fall under the federal government's public domain licensing provisions. Furthermore, I don't see any mention at the United States Air Force's specific page (http://www.afspc.af.mil/news/story.asp?storyID=123061917) stating that the images used are "only [licensed] for their use" and do not fall under the typical and expected public domain rules; the page featuring the photograph discussed only says that it's a "Photo by Andy Wolfe".
Privatephotographer (talk · contribs) in the deletion discussion for File:081108-F-9999S-101.jpg claims that "[i]mages that are Air Force photos have the photographers rank to indicate" discounts contractors and civilian personnel working for the Air Force and producing material for Public Affairs.
Air Force Instruction (AFI) 35-107 (Public Web Communications) paragraph 7.1.4 and AFI 51-303 (Intellectual Property--Patents, Patent Related Matters, Trademarks and Copyrights) paragraph 10 both express that substantive permission must be obtained to use copyrighted works and a need to do so must be established. It's also been my experience that .mil and .gov top-level domain sites expressly note or mention when non-public domain material is being presented (e.g. the NASA logo).
Lastly, has Mr. Wolfe or the US Air Force been contacted regarding this image? The manner to do so for the latter appears on this page.

- LinkedIn's profile is not entered by multiple users (like Wikipedia), but by Andy Wolfe himself; it is reliable and pertinent here. The details are also corroborated by his profile on http://webcache.googleusercontent.com/search?q=cache:BZyW7wtgx34J:www.aviationphotographers.org/portfolios/WolfeA/index.htm+andy+wolfe+lockheed&cd=2&hl=en&ct=clnk&gl=sg&source=www.google.com (International Society for Aviation Photography), which states:
Andy Wolfe is a professional photographer working in flight test for Lockheed Martin Aeronautics. He provides still and video support for various LM Aero programs at Edwards AFB as well as some other locations. After graduating from the University of Texas at Arlington with a degree in Photojournalism, he freelanced for various aviation publications while working in Procurement at Lockheed. Eventually he was able to couple his passion for Aviation Photography with his career at Lockheed and moved from Fort Worth to begin work in Multimedia at Edwards. He still calls Texas home but photographing Vipers and Raptors on a regular basis keeps him firmly planted in California.
- Furthermore, a search on Google with the terms "Andy Wolf" and Lockheed shows the military's prevalent use of photographs by this private individual, giving misleading credits as described in the DR for File:081108-F-9999S-101.jpg.
- Per Commons:Project scope/Evidence, it is Commons policy that the burden of proof lies on the uploader or other person arguing for the file to be retained to demonstrate that as far as can reasonably be determined:
- the file is in the public domain or is properly licensed, and
- that any required consent has been obtained.
- Per Commons:Project scope/Precautionary principle, there is reasonable doubt that this photograph is in the public domain; it was taken by a private individual (this photograph is in the same category as File:081108-F-9999S-101.jpg).
